AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, further providing for 3 State share of fines and for municipal share of fines. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Sections 3571(b)(4)(i) and 3573(b)(3)(i) of Title 7 42 of the Pennsylvania Consolidated Statutes are amended to 8 read: 9 § 3571. Commonwealth portion of fines, etc. 10 * * * 11 (b) Vehicle offenses.-- 12 * * * 13 (4) When prosecution under 75 Pa.C.S. § 3731 (relating 14 to driving under influence of alcohol or controlled 15 substance) is the result of State Police action, 50% of all 16 fines forfeited, recognizances and other forfeitures imposed, 17 lost or forfeited shall be payable to the Commonwealth, for
1 credit to the Motor License Fund, and 50% shall be payable to 2 the county which shall be further divided as follows: 3 (i) Fifty percent of the moneys received shall be 4 allocated to the appropriate county authority which 5 implements the county drug and alcohol program to be used 6 solely for the purposes of aiding programs promoting 7 drug-abuse and alcoholism prevention, education, 8 treatment and research. Programs under this subparagraph 9 include Project DARE (Drug and Alcohol Resistance 10 Education). 11 * * * 12 § 3573. Municipal corporation portion of fines, etc. 13 * * * 14 (b) Vehicle offenses.-- 15 * * * 16 (3) When prosecution under 75 Pa.C.S. § 3731 (relating 17 to driving under influence of alcohol or controlled 18 substance) is the result of local police action, 50% of all 19 fines forfeited, recognizances and other forfeitures imposed, 20 lost or forfeited shall be payable to the municipal 21 corporation under which the local police are organized and 22 50% shall be payable to the county which shall be further 23 divided as follows: 24 (i) Fifty percent of the moneys received shall be 25 allocated to the appropriate county authority which 26 implements the county drug and alcohol program to be used 27 solely for the purposes of aiding programs promoting 28 drug-abuse and alcoholism prevention, education, 29 treatment and research.
