AN ACT

Amending Titles 66 (Public Utilities) and 75 (Vehicles) of the

2

Pennsylvania Consolidated Statutes, providing for

3

identification requirements for railroad employees; and

4

further providing for carrying and exhibiting driver's

5

license on demand.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Title 66 of the Pennsylvania Consolidated

9

Statutes is amended by adding a section to read:

10

§ 2710.  Identification requirements for railroad employees.

11

Employees of the railroad shall carry photo identification

12

furnished them by the railroad on their person at all times.

13

Section 2.  Section 1511 of Title 75 is amended to read:

14

§ 1511.  Carrying and exhibiting driver's license on demand.

15

(a)  General rule.--[Every] Except as provided in subsection

16

(a.1), every licensee shall possess a driver's license issued to

17

the licensee at all times when driving a motor vehicle and shall

18

exhibit the license upon demand by a police officer, and when

19

requested by the police officer the licensee shall write the

licensee's name in the presence of the officer in order to

2

provide identity.

(a.1)  Exception.--Engineers, conductors, brakemen or other

4

members of the crew of a locomotive or train being operated upon

5

rails, including operation on a railroad crossing over a public

6

street, road or highway, shall not be required to exhibit their

7

driver's license upon demand by a police officer in connection

8

with the operation of a locomotive or train within this

9

Commonwealth.

(b)  Production to avoid penalty.--No person shall be

11

convicted of violating this section or section 1501(a) (relating

12

to drivers required to be licensed) if the person:

13

(1)  produces at the headquarters of the police officer

14

who demanded to see the person's license, within 15 days of

15

the demand, a driver's license valid in this Commonwealth at

16

the time of the demand; or

17

(2)  if a citation has been filed, produces at the office

18

of the issuing authority, within 15 days of the filing of the

19

citation, a driver's license valid in this Commonwealth on

20

the date of the citation.

21

Section 3.  This act shall take effect in 60 days.
