           COY, MANDERINO, BELFANTI, WOJNAROSKI, MANN, TRELLO, SOLOBAY,
           YOUNGBLOOD, FREEMAN, THOMAS, ARGALL, TRAVAGLIO, GRUCELA,
           GEIST, PETRARCA, PLATTS, DeLUCA, COLAFELLA, TANGRETTI AND
           STEVENSON, SEPTEMBER 27, 1999

                                     AN ACT

     1  Amending the act of February 9, 1999 (P.L.1, No.1), entitled "An
     2     act providing for borrowing for capital facilities;
     3     conferring powers and duties on various administrative
     4     agencies and officers; making appropriations; and making
     5     repeals," further providing for eligibility for sports
     6     facility financing.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 503 of the act of February 9, 1999
    10  (P.L.1, No.1), known as the Capital Facilities Debt Enabling
    11  Act, is amended to read:
    12  Section 503.  Eligibility.
    13     In order for a facility to qualify for grants of Commonwealth
    14  funds, the professional sports organization utilizing the
    15  facility must certify that:
    16         (1)  it maintains its headquarters, principal business
    17     offices, training facilities and camps, except baseball
    18     spring training, and related enterprises and activities,


     1     except minor league activities, in this Commonwealth;
     2         (2)  except for a sole proprietorship, it is
     3     incorporated, organized or otherwise created under the laws
     4     of this Commonwealth; [and]
     5         (3)  it will continue to comply with the certifications
     6     under paragraphs (1) and (2) for the duration of the lease
     7     under section 504(1) or for the initial term of the debt,
     8     whichever is longer[.]; and
     9         (4)  it will file quarterly written reports with the
    10     Governor and the Local Government Committee of the Senate and
    11     the Local Government Committee of the House of
    12     Representatives. The reports will describe in detail the
    13     progress of the construction or renovation of the facility
    14     including expenditures of grant and other funds to date,
    15     problems encountered or anticipated and solutions or proposed
    16     solutions, percentage of completion to date and anticipated
    17     date of completion. The reports will be filed until the
    18     construction or renovation of a facility is completed.
    19     Section 2.  This act shall take effect immediately.
