AN ACT
Amending Title 58 (Oil and Gas) of the Pennsylvania Consolidated
Statutes, in development, further providing for well permits,
for general gas storage reservoir operations and for
regulations.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3211 of Title 58 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
§ 3211. Well permits.

(b.3) Pennsylvania Turnpike Commission.--If the applicant
intends to use or establish a gas transmission line located in
the Pennsylvania Turnpike's right-of-way, then the applicant
shall attach a copy of the expected fee arrangement between the
applicant and the Pennsylvania Turnpike Commission.

Section 2. Sections 3233(f)(1) and 3274 of Title 58 are
amended to read:
§ 3233. General gas storage reservoir operations.

(f) Duty of storage reservoir operator.--The following shall
apply:
(1) A person owning or operating a storage reservoir
subject to this chapter shall have a duty to:
(i) Maintain all wells drilled into or through the
reservoir in a condition and operate them in a manner
sufficient to prevent the escape of gas.
(ii) Operate and maintain the reservoir and its
facilities as prescribed by departmental regulations and
at a pressure which will prevent gas from escaping, but
the pressure shall not exceed the highest rock pressure
found to have existed during the production history of
the reservoir or another high pressure limit approved by
the department after holding a conference under section
3251 based on geological and production knowledge of the
reservoir, its character, permeability distribution and
operating experience.
(iii) Have a valid fee arrangement with the
Pennsylvania Turnpike Commission for use of gas
transmission lines that are located in the Pennsylvania
Turnpike's right-of-way.

§ 3274. Regulations.
(a) Environmental Quality Board.--The Environmental Quality
Board shall promulgate regulations to implement this chapter.
(b) Pennsylvania Turnpike Commission.--The Pennsylvania
Turnpike Commission shall promulgate regulations relating to
commercial use of the Pennsylvania Turnpike's right-of-way for
gas transmission lines under this chapter, including setting a

fee structure.
Section 3. This act shall take effect in 60 days.
