        REFERRED TO COMMITTEE ON GAME AND FISHERIES, JUNE 19, 2001

                                     AN ACT

     1  Amending Titles 30 (Fish) and 34 (Game) of the Pennsylvania
     2     Consolidated Statutes, providing license fee reductions for
     3     individuals with disabilities.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 102 of Title 30 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a definition to read:
     8  § 102.  Definitions.
     9     Subject to additional definitions contained in subsequent
    10  provisions of this title which are applicable to specific
    11  provisions of this title, the following words and phrases when
    12  used in this title shall have, unless the context clearly
    13  indicates otherwise, the meanings given to them in this section:
    14     * * *
    15     "Individual with a disability."  An individual who:
    16         (1)  has a physical or mental impairment which

     1     substantially limits one or more of the major life activities
     2     of the individual;
     3         (2)  has a record of having an impairment under paragraph
     4     (1); or
     5         (3)  is regarded as having an impairment under paragraph
     6     (1).

     8     Section 2.  Title 30 is amended by adding a section to read:
     9  § 2707.1.  Individuals with disabilities.
    10     If the commission certifies that an applicant for licensure
    11  under this chapter is an individual with a disability, the
    12  applicant shall be entitled to a discount of 40% of the fee
    13  under section 2715(a) (relating to license and issuing fees).
    14     Section 3.  Section 102 of Title 34 is amended by adding a
    15  definition to read:
    16  § 102.  Definitions.
    17     Subject to additional definitions contained in subsequent
    18  provisions of this title which are applicable to specific
    19  provisions of this title, the following words and phrases when
    20  used in this title shall have the meanings given to them in this
    21  section unless the context clearly indicates otherwise:

    23     "Individual with a disability."  An individual who:
    24         (1)  has a physical or mental impairment which
    25     substantially limits one or more of the major life activities
    26     of the individual;
    27         (2)  has a record of having an impairment under paragraph
    28     (1); or
    29         (3)  is regarded as having an impairment under paragraph

     2     Section 4.  Section 2706 of Title 34 is amended by adding a
     3  subsection to read:
     4  § 2706.  Resident license and fee exemptions.
     5     * * *
     6     (b.1)  Individuals with disabilities.--If the commission
     7  certifies that an applicant for licensure under this chapter is
     8  an individual with a disability, the applicant shall be entitled
     9  to a discount of 25% of the fee under section 2709(a) (relating
    10  to license costs and fees).

    12     Section 5.  This act shall take effect in 60 days.
