AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, defining "motorized scooter"; and providing for
3 prohibitions on operation of motorized scooters.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 102 of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended by adding a definition to read:
8 § 102. Definitions.
9 Subject to additional definitions contained in subsequent
10 provisions of this title which are applicable to specific
11 provisions of this title, the following words and phrases when
12 used in this title shall have, unless the context clearly
13 indicates otherwise, the meanings given to them in this section:

15 "Motorized scooter." Any two-wheeled device that has
16 handlebars, is designed to be stood or sat upon by the operator
17 and is powered by a gasoline or electric motor that is capable
18 of propelling the device with or without human propulsion. The
1 term does not include any of the following:
2 (1) A motorcycle.
3 (2) A motor-driven cycle.
4 (3) A motorized pedalcycle.

6 Section 2. Chapter 35 of Title 75 is amended by adding a
7 subchapter to read:

11 3581. Prohibitions.
12 § 3581. Prohibitions.
13 An operator of a motorized scooter may not:
14 (1) Operate the motorized scooter on a highway, shoulder
15 of a highway or trafficway.
16 (2) Operate the motorized scooter on a sidewalk, except
17 as may be necessary to enter or leave adjacent property.
18 Section 3. This act shall take effect in 60 days.
