AN ACT
1 Amending Title 1 (General Provisions) of the Pennsylvania
2 Consolidated Statutes, further providing for sovereign
3 immunity as it relates to the Pennsylvania Housing Finance
4 Agency.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 2310 of Title 1 of the Pennsylvania
8 Consolidated Statutes is amended to read:
9 § 2310. Sovereign immunity reaffirmed; specific waiver.
10 Pursuant to section 11 of Article I of the Constitution of
11 Pennsylvania, it is hereby declared to be the intent of the
12 General Assembly that the Commonwealth, and its officials and
13 employees acting within the scope of their duties, shall
14 continue to enjoy sovereign and official immunity and remain
15 immune from suit except as the General Assembly shall
16 specifically waive the immunity. A suit against the Pennsylvania
17 Housing Finance Agency shall be a suit against the Commonwealth.
18 When the General Assembly specifically waives sovereign
1 immunity, a claim against the Commonwealth and its officials and
2 employees shall be brought only in such manner and in such
3 courts and in such cases as directed by the provisions of Title
4 42 (relating to judiciary and judicial procedure) unless
5 otherwise specifically authorized by statute.
6 Section 2. This act shall have general retroactive effect,
7 except that it shall not apply to actions permitted by
8 decisional law in which suit has been filed prior to or on the
9 effective date of this act.
10 Section 3. This act shall take effect immediately.
