HOUSE BILL

                               A JOINT RESOLUTION

     1  Proposing an amendment to the Constitution of the Commonwealth
     2     of Pennsylvania, providing for the election of the Secretary
     3     of Education.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby resolves as follows:
     6     Section 1.  The following amendment to the Constitution of
     7  Pennsylvania is proposed in accordance with Article XI:
     8     That section 8(a) of Article IV be amended and that the
     9  article be amended by adding a section to read:
    10  § 4.2.  Secretary of Education.
    11     A Secretary of Education shall be chosen by the qualified
    12  electors of the Commonwealth on the day the general election is
    13  held for the Auditor General, State Treasurer and Attorney
    14  General. The Secretary of Education shall hold office during
    15  four years from the third Tuesday of January next ensuing such
    16  election and shall not be eligible to serve continuously for
    17  more than two successive terms. The Secretary of Education shall


     1  exercise such powers and perform such duties as may be imposed
     2  by law.
     3  § 8.  Appointing power.
     4     (a)  The Governor shall appoint [a Secretary of Education
     5  and] such [other] officers as he shall be authorized by law to
     6  appoint. The appointment of [the Secretary of Education and of]
     7  such [other] officers as may be specified by law[,] shall be
     8  subject to the consent of two-thirds or a majority of the
     9  members elected to the Senate as is specified by law.
    10     * * *
    11     Section 2.  Upon approval of this amendment by the electors,
    12  there shall be a vacancy in the office of Secretary of Education
    13  which shall be filled as provided herein.
    14     Section 3.  (a)  Upon the first passage by the General
    15  Assembly of this proposed constitutional amendment, the
    16  Secretary of the Commonwealth shall proceed immediately to
    17  comply with the advertising requirements of section 1 of Article
    18  XI of the Constitution of Pennsylvania and shall transmit the
    19  required advertisements to two newspapers in every county in
    20  which such newspapers are published in sufficient time after
    21  passage of this proposed constitutional amendment.
    22     (b)  Upon the second passage by the General Assembly of this
    23  proposed constitutional amendment, the Secretary of the
    24  Commonwealth shall proceed immediately to comply with the
    25  advertising requirements of section 1 of Article XI of the
    26  Constitution of Pennsylvania and shall transmit the required
    27  advertisements to two newspapers in every county in which such
    28  newspapers are published in sufficient time after passage of
    29  this proposed constitutional amendment. The Secretary of the
    30  Commonwealth shall submit this proposed constitutional amendment

     1  to the qualified electors of this Commonwealth at the first
     2  primary, general or municipal election occurring at least three
     3  months after the proposed constitutional amendment is passed by
     4  the General Assembly which meets the requirements of and is in
     5  conformance with section 1 of Article XI of the Constitution of
     6  Pennsylvania.
