                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," prohibiting school directors from
     6     receiving compensation as school treasurer.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 438, act of March 10, 1949 (P.L.30,
    10  No.14), known as the "Public School Code of 1949," is amended to
    11  read:
    12     Section 438.  Compensation.--School treasurers shall be paid
    13  such compensation as the boards of school directors of the
    14  respective districts may determine. In all school districts of
    15  the second, third, and fourth class such compensation or
    16  commission shall not exceed two per centum of the amount of
    17  funds paid out on school orders. No compensation shall be
    18  allowed to any school treasurer on account of any balance in his
    19  hands paid over to his successor, nor for the repayment of any


     1  loan or redemption of bonds, whether upon order or otherwise. In
     2  those school districts where board members may serve as the
     3  treasurer, such board member will receive no compensation except
     4  reimbursement for actual and necessary expenses incurred in his
     5  activities as treasurer and board member. The compensation
     6  received by each school treasurer for the preceding year shall
     7  be reported annually to the [Superintendent of Public
     8  Instruction] Secretary of Education, and be printed in his
     9  report.
    10     Section 2.  This act shall take effect in 60 days.
