                                     AN ACT

     1  Providing for responsibility of owners of shopping centers and
     2     malls for short-term vendors.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Short-Term
     7  Vendor Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Short-term vendor."  A vendor who, by lease or other
    13  agreement, is authorized to sell products or services at a
    14  shopping center or mall for not more than 60 days.
    15  Section 3.  Responsibility.
    16     The owner of a shopping center or mall shall be responsible
    17  for the acts of short-term vendors who fail to provide the


     1  products or services for which they were paid by customers, and
     2  shall reimburse any such customers who file valid claims with
     3  the owner of the shopping center or mall within 90 days of the
     4  promised date of delivery of the product or service.
     5  Section 4.  Limitation.
     6     The limit on payments with respect to claims against any
     7  particular short-term vendor shall be $1,000.
     8  Section 5.  Bond.
     9     The owner of a shopping center or mall may require short-term
    10  vendors to post a bond of $1,000 to cover claims which may be
    11  filed under this act.
    12  Section 6.  Effective date.
    13     This act shall take effect in 60 days.
