                                     AN ACT

     1  Amending the act of February 11, 1976 (P.L.14, No.10), entitled
     2     "An act authorizing development of rural and intercity common
     3     carrier surface transportation," authorizing grants to
     4     provide free or reduced fare local transportation for persons
     5     sixty years of age or older.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Subsection (b) of section 2, act of February 11,
     9  1976 (P.L.14, No.10), known as the "Pennsylvania Rural and
    10  Intercity Common Carrier Surface Transportation Assistance Act,"
    11  is amended to read:
    12     Section 2.  Findings and Declaration of Policy.--* * *
    13     (b)  Therefore, it is hereby declared to be the policy of the
    14  General Assembly of the Commonwealth of Pennsylvania to promote
    15  the health, safety, convenience and welfare of its inhabitants
    16  by means of State financed projects and financial assistance for
    17  the development of efficient and coordinated rural and intercity


     1  common carrier surface transportation systems, facilities and
     2  services and to provide free or reduced fare local transit for
     3  the elderly. Such purposes are hereby declared to be public
     4  uses.
     5     Section 2.  Section 4 of the act is amended by adding a
     6  paragraph to read:
     7     Section 4.  Program Authorizations.--The department is hereby
     8  authorized, within the limitations hereinafter provided:
     9     * * *
    10     (6)  To make grants to agencies and instrumentalities of the
    11  Commonwealth and to municipalities, counties or their
    12  instrumentalities, from the State Lottery Fund to pay estimated
    13  transit losses resulting from granting free rides to persons 60
    14  years of age and older on fixed route services; and to pay all
    15  but 10¢ or 10% of the cost of fares whichever is greater, for
    16  nonfixed route transportation services to elderly persons 60
    17  years of age or older on local transit systems. On nonfixed
    18  route services, the elderly individual or some other third party
    19  will be required to pay the difference between the actual costs
    20  and the amount granted under this program. The department shall
    21  promulgate such rules and regulations as are necessary to carry
    22  out the purposes of this paragraph.
    23     Section 3.  This act shall take effect in 60 days.
