Effective date. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 CHAPTER 1 12 GENERAL PROVISIONS 13 Section 101. Short title. 14 This act shall be known and may be cited as the "Youth Summer 15 Employment Act." 16 Section 102. Legislative finding. 17 It is hereby determined and declared as a matter of 18 legislative finding that: 19 (1) because the ranks of the youthful unemployed swell 20 manifold during the summer recess of secondary schools and 21 institutions of higher learning; 22 (2) because many youth are desirous and capable of 23 successfully discharging summer employment if employment 24 opportunities were available to them; and 25 (3) because throughout this Commonwealth numerous 26 private sector employers, community or neighborhood groups 27 and agencies and political subdivisions, public authorities 28 and agencies have need for the services of youth during the 29 summer months. 30 There exists a need to provide grants for the employment of 19770H1457B1736 - 2 -
1 youths during the summer months according to the provisions of 2 this act. 3 Section 103. Definitions. 4 The following words and phrases when used in this act shall 5 have, unless the context clearly indicates otherwise, the 6 meanings given to them in this section: 7 "Department." The Department of Commerce of the Commonwealth 8 of Pennsylvania. 9 "Energy conservation program." A program involving the 10 hiring of youth to perform work designed to reduce or eliminate 11 waste of energy resources. 12 "Secretary." The Secretary of Commerce of the Commonwealth. 13 "Summer employment." Employment which commences on or after 14 June 15 and terminates on or before September 15. 15 "Youth." A permanent resident of the Commonwealth who has 16 attained age 14, but has not attained age 22, at the time of 17 application for summer employment. 18 CHAPTER 2 19 GRANTS 20 Section 201. Grants for summer employment. 21 Grants for the hiring of youths for summer employment shall 22 be available to employers in the private sector who develop 23 programs for the hiring of youths approved by the Secretary of 24 Commerce, to community or neighborhood groups and agencies which 25 develop programs for the hiring of youths approved by the 26 Secretary of Commerce and to political subdivisions, public 27 authorities and agencies which develop energy conservation 28 programs for the hiring of youths approved by the Secretary of 29 Commerce. 30 Section 202. Grants to private sector employers. 19770H1457B1736 - 3 -
1 (a) Private sector employers who desire to hire youths for 2 summer employment and who desire to receive grants under the 3 provisions of this act shall submit to the Department of 4 Commerce a proposed program for the hiring of youths for summer 5 employment which shall include, but not be limited to, the 6 following: 7 (1) The number of job positions which the employer will 8 make available to youths. 9 (2) A job description for each position made available 10 to youths, including the proposed gross monthly salary or 11 hourly rate. 12 (3) Anticipated duration of job position. 13 (b) The secretary shall approve or disapprove all programs 14 submitted and may condition approval upon notification. In any 15 event the secretary's decision shall be communicated to the 16 private sector employer within ten working days of receipt of 17 the submitted program. 18 (c) Grants to private sector employers shall be made monthly 19 and shall be in the amount of 50% of each employed youth's gross 20 monthly compensation. 21 Section 203. Grants to community or neighborhood groups and 22 agencies. 23 (a) Priority in making grants to community or neighborhood 24 groups and agencies shall be given to such groups and agencies 25 which on the effective date of this act do not receive grants or 26 funds from Federal, State or local governments for the purpose 27 of hiring youths for summer employment. 28 (b) Community or neighborhood groups and agencies which 29 desire to hire youths for summer employment and which desire to 30 receive grants under the provisions of this act shall submit to 19770H1457B1736 - 4 -
1 the Department of Commerce a proposed program for the hiring of 2 youths for summer employment which shall include, but not be 3 limited to, the following: 4 (1) The purpose or purposes for which the community or 5 neighborhood group or agency was formed. 6 (2) The number of job positions which the community or 7 neighborhood group or agency will make available to youths. 8 (3) A job description for each position made available 9 to youths, including the proposed gross monthly salary or 10 hourly rate. 11 (4) Anticipated duration of job position. 12 (c) The secretary shall approve or disapprove all programs 13 submitted and may condition approval upon modification. In any 14 event, the secretary's decision shall be communicated to the 15 community or neighborhood group or agency within ten working 16 days of receipt of the submitted program. 17 (d) Grants to community or neighborhood groups and agencies 18 shall be made monthly and shall be in the amount of 100% of each 19 employed youth's gross monthly compensation. 20 Section 204. Grants to political subdivisions, public 21 authorities and agencies. 22 (a) Grants to political subdivisions, public authorities and 23 agencies shall be made only to political subdivisions, public 24 authorities and agencies which shall employ youth in energy 25 conservation programs. Such energy conservation programs shall 26 be developed by the political subdivisions, public authorities 27 and agencies and shall include the information required by 28 subsection (b). In the event a politicial subdivision, public 29 authority or agency shall not possess the expertise or personnel 30 to develop an energy conservation program an application may be 19770H1457B1736 - 5 -
1 made by such political subdivision, public authority or agency 2 to the Department of Environmental Resources of the Commonwealth 3 for assistance in developing such program. 4 (b) A political subdivision, public authority or agency 5 which desires to hire youths for summer employment in energy 6 conservation programs and which desires to receive grants under 7 the provisions of this act shall submit a proposed program for 8 the hiring of youths for summer employment in energy 9 conservation, which shall include, but not be limited to, the 10 following: 11 (1) A description of the energy conservation program and 12 the goals of such program. 13 (2) The number of job descriptions which the political 14 subdivision, public authority or agency will make available 15 to youths. 16 (3) A job description for each position made available 17 to youths, including the proposed gross monthly salary or 18 hourly rate. 19 (4) Anticipated duration of job position. 20 (c) The secretary shall approve or disapprove all programs 21 submitted and may condition approval upon modification. In any 22 event the secretary's decision shall be communicated to the 23 political subdivision, public authority or agency within ten 24 working days of receipt of the submitted program. The secretary 25 may consult with the Department of Environmental Resources prior 26 to rendering his decision. 27 CHAPTER 3 28 POWERS AND DUTIES 29 Section 301. Powers of the Department of Commerce. 30 The Department of Commerce shall have the following powers, 19770H1457B1736 - 6 -
1 in addition to other powers provided for by law, to carry out 2 the provisions of this act: 3 (1) To approve or disapprove programs submitted under 4 the provisions of this act or to condition approval of such 5 plans upon modification. 6 (2) To solicit advice, assistance and opinions from the 7 Department of Environmental Resources. 8 (3) To administer the payment of grants in accordance 9 with the provisions of this act. 10 (4) To make rules and regulations for the administration 11 of grants. 12 (5) To do all other things necessary to carry out the 13 purposes and provisions of this act. 14 Section 302. Duties of Department of Environmental Resources. 15 The Department of Environmental Resources shall have the 16 following duties: 17 (1) To develop, in accordance with section 204, energy 18 conservation programs. 19 (2) To assist and advise the Department of Commerce 20 concerning energy conservation programs. 21 (3) To take such acts as may be necessary to carry out 22 the provisions of this act. 23 CHAPTER 4 24 NO DISCRIMINATION AND DIVISION OF GRANTS 25 Section 401. No discrimination. 26 (a) The Department of Commerce shall not approve any grants 27 to private sector employers, community or neighborhood groups or 28 agencies, political subdivisions and public authorities or 29 agencies who or which discriminate against individuals upon the 30 basis of race, religion, nationality or ethnic group or sex. 19770H1457B1736 - 7 -
1 (b) The Department of Environmental Resources shall not 2 develop any energy conservation programs for political 3 subdivisions and public authorities or agencies which 4 discriminate against individuals upon the basis of race, 5 religion, nationality or ethnic group or sex. 6 Section 402. Division of grants. 7 Grants shall be divided equally among, private sector 8 employers, community or neighborhood groups or agencies and 9 political subdivisions and public authorities or agencies. 10 CHAPTER 5 11 APPROPRIATION AND EFFECTIVE DATE 12 Section 501. Appropriation. 13 The sum of $8,000,000, or as much thereof as may be 14 necessary, is hereby specifically appropriated to the Department 15 of Commerce for distribution in the form of grants to carry out 16 the provisions of this act. 17 Section 502.
