| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, in budget and finance, |
3 | further providing for municipal corporation portion of fines, |
4 | etc. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 3573(b)(2) of Title 42 of the |
8 | Pennsylvania Consolidated Statutes is amended to read: |
9 | § 3573. Municipal corporation portion of fines, etc. |

11 | (b) Vehicle offenses.-- |
12 | * * * |
13 | (2) Except as provided in paragraph (3), when |
14 | prosecution under any other provision of Title 75 (except |
15 | Chapter 77 (relating to snowmobiles)) is the result of local |
16 | police action, [one-half of all] any fines, forfeited |
17 | recognizances and other forfeitures imposed, lost or |

1 | forfeited shall be payable to the municipal corporation under |
2 | which the local police are organized[.] at the following |
3 | rates: |
4 | (i) Fifty percent, in the event the prosecution |
5 | resulted from an offense committed on a State-designated |
6 | highway as defined in 75 Pa.C.S. § 102 (relating to |
7 | definitions). |
8 | (ii) One hundred percent, in the event the |
9 | prosecution resulted from an offense committed on a |
10 | highway or bridge under the jurisdiction of the municipal |
11 | corporation. |

13 | Section 2. This act shall take effect in 60 days. |
