                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," further providing for
     5     county employee retirement allowances.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1710(b) of the act of July 28, 1953
     9  (P.L.723, No.230), known as the Second Class County Code,
    10  amended December 4, 1992 (P.L.776, No.121), is amended to read:
    11     Section 1710.  Employes Eligible for Retirement Allowances.--

    13     (b)  Every county employe, other than a member of the police
    14  force or the fire department or a fire inspector or a sheriff or
    15  deputy sheriff, who was initially hired on or prior to the
    16  effective date of this amendatory act, who has reached the age
    17  of sixty years or upwards and who has to his or her credit a
    18  period of service of eight years, but less than twenty years, or


     1  every county employe, other than a member of the police or the
     2  fire department or a fire inspector, who was hired after the
     3  effective date of this amendatory act, who has reached the age
     4  of sixty-five years or upwards, and who has to his or her credit
     5  a period of service of ten years, but less than twenty years,
     6  and every county employe who is a member of the police force or
     7  the fire department or a fire inspector, and who shall have been
     8  a county employe during a period of twenty or more years and has
     9  reached the age of fifty years or upwards shall, upon
    10  application to the board, be eligible for retirement from
    11  service, and shall thereafter receive, during life, except as
    12  hereinafter provided, a retirement allowance plus a service
    13  increment if any, in accordance with the provisions of section
    14  1712. Every county officer or employe who is a sheriff, deputy
    15  sheriff [or], prison guard or probation officer who shall have
    16  been a county officer or employe during a period of twenty or
    17  more years and has reached the age of fifty-five years or
    18  upward, shall, upon application to the board, be eligible for
    19  retirement from service and shall thereafter receive, during
    20  life, except as hereafter provided, a retirement allowance in
    21  accordance with section 1712. The time spent in the employ of
    22  the county or county institution district need not necessarily
    23  have been continuous: Provided, That when any county employe has
    24  twenty or more years service, not necessarily continuous, and
    25  has reached the age of fifty years or upwards, and shall be
    26  separated from the service of the county or county institution
    27  district by reason of no cause or act of his or her own, upon
    28  application to the board he or she shall thereafter receive,
    29  during life, except as hereinafter provided, a retirement
    30  allowance plus a service increment if any, in accordance with

     1  the provisions of section 1712. The aforesaid retirement
     2  allowance plus a service increment if any, shall be subject to a
     3  suspension thereof in accordance with the provisions of
     4  subsection (h) of this section 1710 and subsection (c) of
     5  section 1712.
