AN ACT 1 Requiring certain advisory statements regarding the content of 2 certain music performances; regulating the operation of 3 certain music venues; and prescribing a penalty. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Advisory statements at music venues. 7 (a) General rule.--If a performer's recorded music will be 8 performed at a music venue and if, during the five years prior 9 to the date of the performance, the performer released recorded 10 music containing a parental advisory label issued by the 11 recording industry as to the explicit content of the recorded 12 music, the owner or operator of the music venue or the promoter 13 of the performance shall comply with at least one of the 14 following: 15 (1) Tickets that are sold for the performance at the 16 music venue shall contain, in boldface print not smaller than
1 nine-point type, an advisory stating: 2 PARENTAL ADVISORY WARNING: EXPLICIT CONTENT. 3 (2) Print advertisements for the performance at the 4 music venue shall contain, in boldface print not smaller than 5 nine-point type, an advisory stating: 6 PARENTAL ADVISORY WARNING: EXPLICIT CONTENT. 7 (3) Television, radio or other electronic advertisements 8 for the performance at the music venue shall contain the 9 following: 10 (i) If spoken, an advisory that states: "This 11 artist's music has received the recording industry's 12 parental advisory due to explicit content." 13 (ii) If written, the advertisement shall contain, in 14 boldface print not smaller than nine-point type, an 15 advisory stating: 16 PARENTAL ADVISORY WARNING: EXPLICIT CONTENT. 17 (b) Applicability.--This section shall not apply to a 18 performance at a music venue by a performer whose appearance has 19 not been advertised or promoted. 20 (c) Penalty.--A person who violates this section commits a 21 misdemeanor and shall, upon conviction, be sentenced to pay a 22 fine of not more than $5,000. 23 (d) Definitions.--As used in this section, the term "music 24 venue" means a commercial venue where live music performances 25 are held. 26 Section 2.
