                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for the payment of
     6     indebtedness of involuntarily created school districts.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 225, act of March 10, 1949 (P.L.30,
    10  No.14), known as the "Public School Code of 1949," added
    11  December 7, 1965 (P.L.1034, No.385), is amended to read:
    12     Section 225.  Property and Indebtedness and Rental
    13  Obligations of Former Component School Districts.--(a)  All real
    14  and personal property, indebtedness and rental obligations to an
    15  approved building authority or nonprofit corporation, if any, of
    16  former school districts forming a new school district,
    17  constituted after July 1, 1966, shall become the property,
    18  indebtedness, and rental obligations of such newly constituted
    19  school district. All rights of creditors against any of the


     1  component former school districts shall be preserved against the
     2  new school district. All property theretofore vested in the
     3  component former school districts, and all debts and taxes owing
     4  to the component former school districts, uncollected in the
     5  several component former school districts, and all moneys in the
     6  treasuries of the component former school districts, shall be
     7  paid to the treasurer of the newly constituted school district.
     8     (b)  If any combination of school districts was created
     9  involuntary on the part of the merged districts, such
    10  consolidated district may at any time file a petition with the
    11  State Board of Education to pay any remaining indebtedness as
    12  described in subsection (a). The State Board of Education shall
    13  make such necessary requests to the General Assembly to provide
    14  an appropriation to assume the cost of the consolidated
    15  district's indebtedness.
    16     Section 2.  This act shall take effect immediately.
