| AN ACT |
| |
1 | Amending Title 53 (Municipalities Generally) of the Pennsylvania |
2 | Consolidated Statutes, in employees, providing for basic |
3 | education and continuing education programs for municipal |
4 | secretaries. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Chapter 21 of Title 53 of the Pennsylvania |
8 | Consolidated Statutes is amended by adding a subchapter to read: |

2 | § 2191. Short title of subchapter. |
3 | This subchapter shall be known and may be cited as the |
4 | Municipal Secretary Education Act. |
5 | § 2192. Nonapplicability. |
6 | This subchapter does not apply to cities of the first class, |
7 | second class or second class A. |
8 | § 2193. Definitions. |
9 | The following words and phrases when used in this subchapter |
10 | shall have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Association." The Pennsylvania Local Governmental |
13 | Secretaries Association. |
14 | "Department." The Department of Community and Economic |
15 | Development of the Commonwealth. |
16 | "IIMC." The International Institute of Municipal Clerks. |
17 | "Municipal secretary." Any of the following: |
18 | (1) The appointed municipal secretary of a borough, |
19 | incorporated town, township of the first class or township of |
20 | the second class, including any municipal corporation as |
21 | described in this paragraph which has adopted a home rule |
22 | charter or optional plan. |
23 | (2) The appointed city clerk in a city of the third |
24 | class, including any city of the third class which has |
25 | adopted a home rule charter, optional plan or optional |
26 | charter. |
27 | § 2194. Basic and continuing education programs for municipal |
28 | secretaries. |
29 | (a) Establishment and implementation.--The department, in |
30 | consultation with the association, shall establish and implement |

1 | programs of basic training, examination and qualification of |
2 | municipal secretaries and of continuing education to be met by |
3 | persons qualified as municipal secretaries as condition for |
4 | renewal. The department may contract with a third party to |
5 | provide the basic training, examination, qualification and |
6 | continuing education. |
7 | (b) Contents of basic training program.-- |
8 | (1) The basic training program shall include, but not be |
9 | limited to, the following courses: |
10 | (i) Structure and function of Pennsylvania local |
11 | government. |
12 | (ii) Municipal administration/personnel management. |
13 | (iii) Basic budgeting. |
14 | (iv) Accounting and financial control. |
15 | (v) Community development/municipal services. |
16 | (vi) Meeting management. |
17 | (vii) Bidding and contracting. |
18 | (viii) Records management. |
19 | (ix) Management theory and practice. |
20 | (x) Intergovernmental cooperation. |
21 | (xi) Public relations. |
22 | (xii) Working with emergency service organizations. |
23 | (xiii) Municipal minutes and records and the act of |
24 | February 14, 2008 (P.L.6, No.3), known as the Right-to- |
25 | Know Law. |
26 | (xiv) Public notice and advertising requirements and |
27 | 65 Pa.C.S. Ch. 7 (relating to open meetings). |
28 | (xv) Other laws and recent court decisions affecting |
29 | the duties of municipal secretaries. |
30 | (xvi) Ethics. |

1 | (xvii) Computers and technology. |
2 | (2) As a prerequisite to taking the qualification |
3 | examination, a person shall complete the basic training |
4 | program authorized by the department. |
5 | (3) (i) A person shall have the option to sit for the |
6 | qualification examination relating to the basic education |
7 | program. |
8 | (ii) No person may obtain qualification unless that |
9 | person has passed the basic qualification examination. |
10 | (iii) A person who passes the basic qualification |
11 | examination shall be known as a qualified municipal |
12 | secretary. |
13 | (c) Duties of department.--The department shall: |
14 | (1) Make certain a qualified municipal secretary |
15 | certificate is issued to a person who passes the basic |
16 | qualification examination. The certificate shall expire one |
17 | year from the date of issuance, but may be renewed. |
18 | (2) Maintain a register that lists all qualified |
19 | municipal secretaries. The register shall be open to public |
20 | inspection and copying upon payment of a nominal fee. |
21 | (3) Publish, once each year, a list of all qualified |
22 | municipal secretaries on the department's Internet website. |
23 | (4) Determine and approve reasonable fees for the |
24 | training program and for testing and qualification. The | <-- |
25 | municipal secretary shall be personally liable for the cost |
26 | of the program, testing and qualification unless the |
27 | governing body that appointed the municipal secretary agrees |
28 | to pay for the cost in whole or in part. |
29 | (d) Prohibition.--It shall be unlawful on or after the |
30 | effective date of this subchapter for any individual to hold |

1 | himself out as being qualified in training under this section |
2 | unless the person holds a current, valid certificate. |
3 | (e) Construction.--Nothing in this section shall be |
4 | construed to prevent a person from participating in the |
5 | department's basic training program and obtaining qualification. |
6 | (f) Hours required.--Each qualified municipal secretary |
7 | shall be required to obtain eight hours of mandatory continuing |
8 | education during each year. |
9 | (g) Updates.--The department, in consultation with the |
10 | association, shall devise the continuing education program to |
11 | include, but not be limited to, updates for basic training |
12 | course topics and other contemporary issues. |
13 | (h) Notification of requirements.--The department shall |
14 | inform qualified municipal secretaries of the continuing |
15 | education requirement when it issues the certificates. |
16 | (i) Renewals.--Renewal of qualification shall be on an |
17 | annual basis upon completion of continuing education |
18 | requirements as provided in this subchapter. The municipal | <-- |
19 | secretary shall be personally liable for the cost of the program |
20 | and qualification unless the governing body that appointed the |
21 | municipal secretary agrees to pay for the cost in whole or in |
22 | part. |
23 | (j) Responsibility for cost.-- | <-- |
24 | (1) A governing body that requires a municipal secretary |
25 | to achieve or renew the designation of qualified municipal |
26 | secretary shall be liable for the cost of the program, |
27 | testing and qualification. |
28 | (2) An individual currently employed as a municipal |
29 | secretary that is not required by the appointing municipality |
30 | to complete or renew the certification program shall be |

1 | personally liable for the cost of the program, testing and |
2 | qualification, unless the governing body that appointed the |
3 | municipal secretary agrees to pay for the cost in whole or in |
4 | part. |
5 | (3) An individual not currently employed as a municipal |
6 | secretary who wishes to complete the certification program |
7 | shall be personally liable for the cost of the program, |
8 | testing and qualification. |
9 | (j) (k) Criteria for existing education.--The department, in | <-- |
10 | consultation with the association, shall adopt criteria to |
11 | provide municipal secretaries with existing education the right |
12 | to receive credit toward the qualified municipal secretary |
13 | program, including, but not limited to: |
14 | (1) Completion of the IIMC programs of Certified |
15 | Municipal Clerk designation or Advanced Academy for |
16 | Education. |
17 | (2) A bachelor of science degree in public |
18 | administration or a bachelor of arts degree in political |
19 | science. |
20 | (3) IIMC certification programs for municipal |
21 | secretaries not currently holding the Certified Municipal |
22 | Clerk or Advanced Academy for Education designation. |
23 | § 2195. Construction. |
24 | Nothing in this subchapter shall be construed to require a |
25 | municipal secretary to become a qualified municipal secretary or |
26 | maintain that qualification unless required by the municipal |
27 | governing body that appointed the secretary. |
28 | Section 2. This act shall take effect in 60 days. |
