        AS REPORTED FROM COMMITTEE ON LOCAL GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, SEPTEMBER 19, 1983

                                     AN ACT

     1  Amending the act of May 31, 1945 (P.L.1198, No.418), entitled,
     2     as amended, "An act providing for the conservation and
     3     improvement of land affected in connection with surface
     4     mining; regulating such mining; and providing penalties,"
     5     exempting municipalities from the bond requirement relating
     6     to the operation of gravel pits.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 4 of the act of May 31, 1945 (P.L.1198,
    10  No.418), known as the Surface Mining Conservation and
    11  Reclamation Act, is amended by adding a subsection to read:
    12     Section 4.  Mining Permit; Reclamation Plan; Bond.--* * *
    13     (d.1)  Notwithstanding any provision of this act, a
    14  municipality which owns or operates a gravel pit, OPERATES OR     <--
    15  LEASES AS LESSOR OR LESSEE A GRAVEL PIT FOR DIRECT USE BY THE
    16  MUNICIPALITY shall not be required to post a bond with the
    17  department.

     1     Section 2.  This act shall take effect immediately.
