                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing for a foster
     4     parent registry.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     8  as the Public Welfare Code, is amended by adding a section to
     9  read:
    10     Section 710.  Foster Parent Registry.--(a)  The department
    11  shall maintain a registry of all foster parents in this
    12  Commonwealth. This registry shall contain, at a minimum, the
    13  following information in relation to each foster parent:
    14     (1)  A chronological history of the parent, including all
    15  prior periods of custody of any minor.
    16     (2)  A history of the parent's association with any public or
    17  private child welfare agency, including the reasons why a parent
    18  or the agency terminated such association.

     1     (3)  A criminal history of the parent in relation to any
     2  charges or convictions of child abuse or any other crime
     3  involving a child.
     4     (b)  The department may promulgate rules and regulations
     5  necessary to carry out this section and may arrange for, or
     6  conduct on its own, such background investigations of foster
     7  parents as necessary to fulfill the requirements and purposes of
     8  the registry.
     9     (c)  As used in this section, "foster parent" means any
    10  person who, on the effective date of this section and acting in
    11  the capacity of foster parent, has custody of a minor or who,
    12  within the five-year period immediately prior to the effective
    13  date of this section, had custody of a minor while acting in the
    14  capacity of a foster parent.
    15     Section 2.  This act shall take effect immediately.
