AN ACT 1 Imposing a moratorium on mass burn incinerators. 2 The General Assembly of the Commonwealth of Pennsylvania 3 hereby enacts as follows: 4 Section 1. Findings. 5 The General Assembly, conscious of the public health concerns 6 over the disposal of wastes by mass burn incinerators, finds 7 that the public health, safety and welfare will be served by 8 placing a moratorium on issuing permits for the construction and 9 operation of facilities proposed to be used for mass burn 10 incineration of wastes. 11 Section 2. Moratorium. 12 (a) Prohibition.--On and after the effective date of this 13 act, the Department of Environmental Resources shall not issue 14 the required permits under the act of January 8, 1960 (1959 15 P.L.2119, No.787), known as the Air Pollution Control Act, or 16 the act of July 7, 1980 (P.L.380, No.97), known as the Solid 17 Waste Management Act, for the construction or operation of any
1 facility proposed to be used as a mass burn incinerator. This 2 moratorium will not affect the continued operation of existing 3 facilities currently being used for mass burn incineration of 4 wastes. 5 (b) End of moratorium.--The prohibition contained herein 6 shall remain in effect for 18 months from the effective date of 7 this act. 8 (c) Definition.--For purposes of this act, the term 9 "incinerator" means an enclosed device using controlled flame 10 combustion, the primary purpose of which is to thermally break 11 down hazardous waste. Examples of incinerators are rotary kiln, 12 fluidized bed, and liquid injection incinerators. 13 Section 3. Effective date. 14 This act shall take effect in 60 days. C12L35JLW/19870H1201B1373 - 2 -
