AN ACT 1 Providing for notice and a hearing prior to holding a game hunt 2 in a State park. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Game hunts. 6 The Department of Conservation and Natural Resources shall 7 have the power, and its duty shall be to comply with the 8 following requirements prior to holding a game hunt in a State 9 park: 10 (1) At least 150 days prior to the proposed hunt, the 11 department shall provide notice of the proposed hunt, 12 including the date and objectives of the proposed hunt and 13 the time and place of the hearing required in paragraph (2): 14 (i) in writing to all municipalities abutting the 15 park; 16 (ii) in writing to all legislators representing 17 districts abutting the park; and
1 (iii) by publication in the Pennsylvania Bulletin. 2 (2) At least 60 days prior to the proposed hunt, the 3 department shall hold a public hearing in a municipality 4 abutting the park for the purpose of considering alternative 5 methods of accomplishing the objectives of the proposed hunt. 6 (i) In addition to the notice provided in paragraph 7 (1), notice of the hearing shall be advertised at least 8 seven days in advance of the hearing in a newspaper of 9 general circulation in the area. 10 (ii) At the hearing the department shall maintain an 11 attendance roster containing a space for persons to 12 indicate their desire to receive a copy of the 13 department's decision with respect to the proposed hunt. 14 (3) At least 30 days prior to the proposed hunt, the 15 department shall hold a public meeting in a municipality 16 abutting the park for the purpose of explaining its decision 17 concerning the proposed hunt. Prior to the public meeting, 18 the department shall provide notice of the time and place of 19 the meeting and a copy of the decision and explanation to: 20 (i) all municipalities abutting the park; 21 (ii) all legislators representing districts abutting 22 the park; and 23 (iii) all persons who indicated their desire to 24 receive a copy of the decision on the attendance roster 25 at the public hearing or in writing addressed to the 26 department. 27 Section 2.
