AN ACT
1 Amending the act of May 1, 1933 (P.L.103, No.69), entitled, "An
2 act concerning townships of the second class; and amending,
3 revising, consolidating, and changing the law relating
4 thereto," imposing additional responsibilities on State
5 associations and authorizing additional delegates to annual
6 meetings of State associations.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 610 of the act of May 1, 1933 (P.L.103,
10 No.69), known as The Second Class Township Code, reenacted and
11 amended July 10, 1947 (P.L.1481, No.567), amended September 2,
12 1965 (P.L.477, No.241) and May 21, 1976 (P.L.146, No.70), is
13 amended to read:
14 Section 610. State Association Authorized.--(a) The
15 formation of a State Association of Township Supervisors is
16 hereby authorized. The association shall hold annual meetings,
17 at such time and place within the Commonwealth as it may
18 designate, for the purpose of discussing various questions and
19 subjects pertaining to the duties of township supervisors, and
1 devising of uniform, economical and efficient methods of 2 administering the affairs of townships. The association shall, 3 in addition, at such meetings, conduct seminars on subjects 4 related to the management of the township. These courses shall 5 include, but not be limited to, budget preparation, auditing; 6 fiscal management; investment of funds; duties and 7 responsibilities of township officials. For purposes of this 8 section, programs offered by the Department of Community Affairs 9 may be incorporated into the annual conference. 10 (b) The association, at its annual meeting, by majority vote 11 of all the voting delegates there represented shall have power 12 to adopt and amend bylaws to govern the association which shall 13 govern the qualification of delegates, election of officers, 14 their designation, qualifications and duties, payment of dues 15 and other organizational details. The association shall function 16 under these bylaws for advancing the interest of and betterment 17 of township government in townships of the second class. 18 (c) The dues as adopted in these bylaws are legal 19 expenditures of the townships and are to be used to pay for the 20 services, publications and other expenses, including the rental 21 and acquisition of real estate to be used for association 22 purposes and activities authorized by the association or 23 incurred in behalf of the association by its officers and 24 executive committee. 25 (d) The State Association of Township Supervisors is hereby 26 authorized to purchase, take, receive, lease as lessee, take by 27 gift or devise, or otherwise acquire, and to own, hold, use and 28 otherwise deal with any real estate, or any interest therein in 29 its own name for association purposes and activities authorized 30 by the association and to mortgage, sell and convey, lease as 19830H1118B1277 - 2 -
1 lessor, and otherwise dispose of all or any part of said real 2 estate in such manner as may be provided in the bylaws of the 3 association. 4 Section 2. Section 611 of the act, amended May 21, 1976 5 (P.L.146, No.70), is amended to read: 6 Section 611. Delegates.--(a) Each county association of 7 township supervisors may elect one township supervisor or 8 township secretary or secretary of the county association for 9 each ten townships, or fraction thereof, within said county, as 10 a voting delegate to each annual meeting of said State 11 association, but each county association shall be entitled to a 12 minimum of two such delegates at each meeting. These delegates 13 expenses may be paid by the respective county association. 14 (b) The supervisors may designate one or more of the 15 following [elected or appointed officials of the township] to 16 attend the annual meeting of the State association: supervisors, 17 [township secretary and/or township manager] elected or 18 appointed officers or township employes. Said convention shall 19 be held in the Commonwealth in accordance with the procedures 20 adopted by the State association. These delegates expenses shall 21 be paid by the respective townships out of the township general 22 fund. 23 (c) (1) Each township with dues paid in the State 24 association shall elect one of those delegates designated in 25 subsection (b) to be the voting delegate at the convention. 26 (2) Each township shall certify the name and address of its 27 elected delegate or delegates and the designated voting delegate 28 to the State association at least fifteen days prior to the 29 opening of the State convention. 30 Section 3.
