AN ACT 1 Amending the act of June 3, 1937 (P.L.1333, No.320), entitled 2 "An act concerning elections, including general, municipal, 3 special and primary elections, the nomination of candidates, 4 primary and election expenses and election contests; creating 5 and defining membership of county boards of elections; 6 imposing duties upon the Secretary of the Commonwealth, 7 courts, county boards of elections, county commissioners; 8 imposing penalties for violation of the act, and codifying, 9 revising and consolidating the laws relating thereto; and 10 repealing certain acts and parts of acts relating to 11 elections," further providing for rules for determining 12 residence for purposes of registering to vote or voting. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. Section 704 of the act of June 3, 1937 (P.L.1333, 16 No.320), known as the Pennsylvania Election Code, is amended by 17 adding subsections to read: 18 Section 704. Rules for Determining Residence.--In 19 determining the residence of a person desiring to register or 20 vote, the following rules shall be followed so far as they may 21 be applicable:
1 * * * 2 (i) If a person has established a relationship with a 3 shelter, to which the person expects to return, in the same 4 relationship, and the shelter accepts first class nonforwardable 5 mail for the person, the shelter shall be considered his or her 6 place of residence. The term "shelter" as used in this 7 subsection shall include only public and private nonprofit 8 shelters which operate residential programs for the homeless, 9 which accept first-class nonforwardable mail for the homeless 10 and which agree that homeless individuals may establish 11 relationships with that shelter which make that shelter the 12 primary residential address for that individual. 13 (j) If a person chooses a general location, e.g. a park 14 bench or a street corner for his or her place of residence, and 15 the person neither owns, rents nor has access to a more specific 16 home or residence, he or she shall be considered to have a 17 residence if a specific location is given and a post office box 18 or proper mailing address is given that the person can use for 19 delivery of the voter identification card. 20 Section 2.
