        INTRODUCED BY METCALFE, GEORGE, CAPPELLI, STERN, BARRAR,
           BASTIAN, BENNINGHOFF, CLARK, EGOLF, HENNESSEY, ROHRER,
           SAYLOR, E. Z. TAYLOR, J. TAYLOR, TIGUE, WALKO AND WILT,
           MARCH 19, 2001

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," further providing for enforcement.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 1642 of the act of June 3, 1937
    15  (P.L.1333, No.320), known as the Pennsylvania Election Code,
    16  added October 4, 1978 (P.L.893, No.171), is amended to read:
    17     Section 1642.  Enforcement.--
    18     (a)  The Attorney General shall have prosecutorial
    19  jurisdiction over all violations connected with any statement or
    20  report and the contents thereof which is to be filed with the
    21  Secretary of the Commonwealth.


     1     (b)  The district attorneys of the respective counties shall
     2  have [jurisdiction] concurrent jurisdiction with the Attorney
     3  General over any other violations committed under this act.
     4     (c)  The district attorney of any county in which a
     5  violation, referred to in subsection (a) occurs, has concurrent
     6  powers and responsibilities with the Attorney General over such
     7  violations.
     8     Section 2.  This act shall take effect in 60 days.
