A SUPPLEMENT
1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act
2 to accept the grant of Public Lands, by the United States, to
3 the several states, for the endowment of Agricultural
4 Colleges," making appropriations to Pennsylvania State
5 University; providing for a basis for payments of the
6 appropriations; and providing a method of accounting for the
7 funds appropriated.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. The following sums, or as much thereof as may be
11 necessary, are hereby appropriated to the Trustees of
12 Pennsylvania State University, for the fiscal year July 1, 1983
13 to June 30, 1984, for the following purposes and amounts:
14 (1) For educational and general expenses..... $109,041,000 <--

20 A COMMISSION FOR INTER-INSTITUTIONAL COMMUNICA-

Payments to Pennsylvania State University on 26 account of the appropriations provided in section 1 shall be 27 made on the basis of costs during the fiscal year. 28 Section 3. If necessary, Pennsylvania State University may 29 transfer funds among the appropriations listed in section 1(1), 30 (2), (3), (5) and (6). The aggregate amount transferred into or 19830H1023B1526 - 2 -
1 out of each appropriation during the fiscal year shall not 2 exceed 5% of the amount specifically appropriated for that 3 purpose. 4 Section 4. (a) Payments to Pennsylvania State University of 5 the appropriations provided in section 1 shall be made monthly 6 during the fiscal year. 7 (b) The monthly payments shall be made in accordance with 8 section 2 on the basis of estimated costs. The estimate of costs 9 shall be submitted by the Pennsylvania State University to the 10 Secretary of Education, the General Assembly and the State 11 Treasurer not later than 30 days prior to the date on which the 12 payment is to be made. 13 Section 5. Notwithstanding any provision of the General 14 Appropriation Act of 1983 relating to the payment of retirement 15 expenses, the Trustees of Pennsylvania State University shall 16 make all required payments to the State Employees' Retirement 17 Fund from the funds appropriated pursuant to this act. 18 Section 6. (a) Pennsylvania State University shall apply 19 the moneys appropriated by this act only for the purposes 20 permitted in this act and shall at all times maintain proper 21 records showing the application of the moneys. Not later than 22 120 days after the close of the fiscal year to which this act 23 relates, Pennsylvania State University shall file with the 24 Secretary of Education, the General Assembly and the Auditor 25 General a statement setting forth the amounts and purposes of 26 all expenditures made from moneys appropriated by this act and 27 other university accounts during the fiscal year, as provided in 28 section 2, used as a basis for receipt of any appropriation 29 during the fiscal year. 30 (b) The statement of expenditures and costs shall be 19830H1023B1526 - 3 -
1 reviewed by the Auditor General who has the right, in respect to 2 the moneys appropriated by this act, to audit and disallow 3 expenditures made for purposes not permitted by this act and to 4 cause such sums to be recovered and paid by Pennsylvania State 5 University to the State Treasurer. In respect to expenditures 6 made by the university from moneys other than those appropriated 7 by this act, the Auditor General has the right to review only 8 and shall file annually with the General Assembly any 9 information concerning these expenditures as the General 10 Assembly or any of its committees may require. 11 Section 7. A report shall be submitted to the Governor and 12 the Appropriations and Education Committees of the Senate and 13 House of Representatives and shall include data for all programs 14 except the Doctor of Medicine program. The report, to be 15 submitted prior to September 1, 1984, shall cover the 12-month 16 period beginning with the summer term 1983 and shall include: 17 (1) The following counts and distributions for each term 18 during the period: 19 (i) The definitions and numbers of faculty members employed 20 full-time, of faculty members employed part-time, of full-time 21 students enrolled in graduate courses, of full-time students 22 enrolled in undergraduate courses, of part-time students 23 enrolled in graduate courses and of part-time students enrolled 24 in undergraduate courses. 25 (ii) The total numbers of undergraduate student credit 26 hours, divided into lower division and upper division course 27 levels and of graduate student credit hours divided into three 28 course levels: master's, first professional and doctoral. 29 (iii) The number of different courses scheduled by level of 30 instruction and the number of sections of individual instruction 19830H1023B1526 - 4 -
1 at each level of instruction. 2 (iv) The number of terms scheduled and the dates thereof. 3 (2) For the summer term and the following academic year in 4 total and for each two-digit Hegis category of instructional 5 programs in higher education as defined by the National Center 6 for Education Statistics, United States Department of Education, 7 a classification of faculty members or other professional 8 employees by title including: professor, associate professor, 9 assistant professor, instructor, lecturer, research associate, 10 librarian and academic administrator; faculty members or other 11 professional employees under each title to be subdivided by type 12 of assignment: teaching and nonteaching, with each set of 13 faculty members or other professional employees to be further 14 subdivided by type of employment: full-time or part-time and the 15 following aggregates for each subdivided classification: 16 (i) The number of faculty and other professional employees 17 and their full-time equivalence in instructional and 18 noninstructional functions. 19 (ii) The sum of credits assigned to undergraduate classroom 20 courses and the sum of credits assigned to graduate classroom 21 courses taught, divided into lower division, upper division, 22 master's, first professional and doctoral course levels. 23 (iii) The sum of credits assigned to undergraduate 24 individual instruction courses and the sum of credits assigned 25 to graduate individual instruction courses taught, divided into 26 lower division, upper division, master's, first professional and 27 doctoral course levels. 28 (iv) The sum of undergraduate classroom student credit hours 29 and the sum of graduate classroom student credit hours 30 generated; divided into lower division, upper division, 19830H1023B1526 - 5 -
1 master's, first professional and doctoral course levels. 2 (v) The sum of undergraduate individual instruction student 3 credit hours and the sum of graduate individual instruction 4 student credit hours generated; divided into lower division, 5 upper division, master's, first professional and doctoral course 6 levels. 7 (vi) The total salary paid for instructional functions and 8 for noninstructional functions and the amount of this salary 9 paid for each of these functions from college or university 10 funds, Federal funds and other funds. 11 (3) For each term of the period covered for each faculty 12 member employed full-time identified by two-digit Hegis category 13 and title, the report shall contain an analysis of the average 14 hours per week spent in college or university-related 15 activities, stating specifically hours spent in undergraduate 16 classroom contact and graduate classroom contact, hours spent in 17 preparation, hours spent in research and hours spent in public 18 service. 19 Section 8. (a) In addition to the requirements in section 7 20 relative to this appropriation, the report covering the 12-month 21 period beginning with the summer term 1983 shall include for all 22 programs of the university: 23 (1) The minimum number of credits required for a 24 baccalaureate degree and for a master's degree. 25 (2) The number of bachelor's degrees, master's degrees, 26 first professional degrees and doctoral degrees awarded in 1981, 27 1982, 1983 and estimated 1984. 28 (b) Pennsylvania State University shall report its revenues 29 and expenditures and present its financial statements required 30 under the provisions of this act in accordance with the "Higher 19830H1023B1526 - 6 -
1 Education Finance Manual of 1975." 2 Section 9. An additional report shall be submitted to the 3 Governor and the Appropriations and Education Committees of the 4 Senate and House of Representatives and shall include data which 5 indicates the increase in recruitment and retention activities 6 of the Pennsylvania State University relating to disadvantaged 7 students and the extent to which such activities have increased 8 or will increase disadvantaged student enrollment. 9 Section 10. Pennsylvania State University shall provide such 10 information as may be necessary to carry out the provisions of 11 this act and in the form and manner as the Department of 12 Education may prescribe. 13 Section 11. Pennsylvania State University shall report its 14 revenues and expenditures and present its financial statements 15 required under the provisions of this act in accordance with 16 generally accepted accounting principles and procedures for 17 educational institutions as set forth in the "Higher Education 18 Finance Manual of 1975," with the exceptions set forth in the 19 "Commonwealth of Pennsylvania Budget Instructions for State 20 Related Universities, Phase I, Fiscal Year 1983-1984." Credits 21 granted for nontraditional programs such as CLEP, lifelong 22 learning etc., including all related costs and revenues thereof 23 shall be excluded from the function of "Instruction" and 24 included under "Public Service." 25 Section 12. This act shall take effect July 1, 1983 or, if 26 enacted subsequent to that date, then immediately. E9L84RZ/19830H1023B1526 - 7 -
