        AS REPORTED FROM COMMITTEE ON GAME AND FISHERIES, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 2, 1975

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1225, No.316), entitled
     2     "An act concerning game and other wild birds and wild
     3     animals; and amending, revising, consolidating, and changing
     4     the law relating thereto," IMPOSING CERTAIN RESTRICTIONS ON    <--
     5     RIGHTS GRANTED AND authorizing the commission to grant
     6     additional rights on State game lands.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Subsection (f) of section 906, act of June 3,
    10  1937 (P.L.1225, No.316), known as "The Game Law," amended July
    11  28, 1953 (P.L.663, No.201) and December 12, 1973 (P.L.392,
    12  No.138), is amended to read:
    13     Section 906.  Use of Lands.--

    15     (f)  The commission may grant any or all of the following
    16  rights on lands acquired for its use, when such grants will not
    17  adversely affect game protection and propagation, and may charge
    18  for such licenses such rental and damages as the commission
    19  deems the conditions and circumstances warrant AND SHALL REQUIRE  <--


     1  THAT THE LICENSEE NOT IMPEDE THE USE OF THE LAND BY SPORTSMEN
     2  AND THAT THE LICENSEE MAINTAIN AND PATROL THE RIGHT SO GRANTED:
     3     (1)  Water rights;
     4     (2)  Rights to maintain airway beacon lights;
     5     (3)  Rights to maintain forest fire observation towers;
     6     (4)  Rights to maintain radio stations and radio towers
     7  solely for National defense, law enforcement or flood
     8  forecasting purposes;
     9     (5)  Rights to maintain ski runs or trails and essential
    10  towing equipment, but excluding rest houses, restaurants or
    11  hotels;
    12     (6)  Rights to the [Department of Highways] Pennsylvania
    13  Department of Transportation to establish and maintain roadside
    14  rests and highway maintenance facilities under such terms and
    15  conditions as the commission shall prescribe;
    16     (7)  Rights to any State or Federal agency to construct,
    17  maintain and operate water impoundments or flowage for flood
    18  control or recreational use;
    19     (8)  Rights to erect, construct, maintain and operate
    20  antennas, towers, stations, cables and other devices and
    21  apparatus, helpful, necessary or required for broadcasting,
    22  telecasting, transmission, relaying or reception of television;
    23     (9)  Rights for underground storage of natural gas;
    24     (10)  Rights to explore for natural gas, oil, water and all
    25  other mineral deposits under such terms and conditions as the
    26  commission shall prescribe.

    28     Section 2.  This act shall take effect immediately.
