AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 1999, to June 30, 2000, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 1999; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the Ben 12 Franklin/IRC Partnership Fund, the Tuition Payment Fund, the 13 Banking Department Fund and the Firearm Records Check Fund to 14 the Executive Department; and to provide appropriations from 15 the Judicial Computer System Augmentation Account to the 16 Judicial Department for the fiscal year July 1, 1999, to June 17 30, 2000; and to provide appropriations from the Motor 18 License Fund for the fiscal year July 1, 1999, to June 30, 19 2000, for the proper operation of the several departments of 20 the Commonwealth and the Pennsylvania State Police authorized 21 to spend Motor License Fund moneys; and to provide for the 22 appropriation of Federal funds to the Executive and Judicial 23 Departments of the Commonwealth and for the establishment of 24 restricted receipt accounts for the fiscal year July 1, 1999, 25 to June 30, 2000, and for the payment of bills remaining 26 unpaid at the close of the fiscal year ending June 30, 1999. 27 TABLE OF CONTENTS 28 PART I. Effective date. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 PART I 9 GENERAL PROVISIONS 10 Section 101. Short title.--This act shall be known and may 11 be cited as the General Appropriation Act of 1999. 12 Section 102. Definitions.--The following words and phrases 13 when used in this act shall have the meanings given to them in 14 this section unless the context clearly indicates otherwise: 15 "Employees." Includes all directors, superintendents, bureau 16 or division chiefs, assistant directors, assistant 17 superintendents, assistant chiefs, experts, scientists, 18 engineers, surveyors, draftsmen, accountants, secretaries, 19 auditors, inspectors, examiners, analysts, statisticians, 20 marshals, clerks, stenographers, bookkeepers, messengers and 21 other assistants in any department, board or commission. 22 "Expenses" and "maintenance." Includes all printing, binding 23 and stationery, food and forage, materials and supplies, 24 traveling expenses, training, motor vehicle supplies and 25 repairs, freight, express and cartage, postage, telephones and 26 telegraph rentals and toll charges, newspaper advertising and 27 notices, public advertising by or through any medium, fuel, 28 light, heat, power and water, minor construction and renovation, 29 repairs or reconstruction of equipment, buildings and 30 facilities, rent of real estate and equipment, premiums on 19990H0980B1088 - 7 -
1 workers' compensation, insurance premiums on policies of 2 liability insurance, insurance premiums on medical payment 3 insurance and surety bonds for volunteer workers, premiums on 4 employee group life insurance and employee and retired employee 5 group hospital and medical insurance, payment of Commonwealth 6 share of Social Security taxes and unemployment compensation 7 costs for State employees, the purchase of replacement or 8 additional equipment and machinery and all other incidental 9 costs and expenses, including payment to the Department of 10 General Services of mileage and other charges for the use of 11 automobiles and rental payments for permanently assigned 12 automobiles and of expenses or costs of services incurred 13 through the Purchasing Fund. The term "expenses" also shall 14 include the medical costs for the treatment of inmates of State 15 institutions when the inmate must be transferred to an outside 16 hospital: Provided, That in no case shall the State institution 17 pay more for patient care than that provided under the State 18 medical assistance program. 19 Section 103. Abbreviations.--The following abbreviations 20 when used in this act shall have the meanings given to them in 21 this section unless the context clearly indicates otherwise: 22 "ARC." State appropriations.--(a) General Fund.--The 22 following sums set forth in this act, or as much thereof as may 23 be necessary, are hereby specifically appropriated from the 24 General Fund to the several hereinafter named agencies of the 25 Executive, Legislative and Judicial Departments of the 26 Commonwealth for the payment of salaries, wages or other 27 compensation and travel expenses of the duly elected or 28 appointed officers and employees of the Commonwealth, for the 29 payment of fees for contractual services rendered, for the 30 purchase or rental of goods and services, printing, public 19990H0980B1088 - 9 -
1 advertising by or through any medium, equipment, land and 2 buildings and for payment of any other expenses, as provided by 3 law or by this act, necessary for the proper conduct of the 4 duties, functions and activities and for the purposes 5 hereinafter set forth for the fiscal year beginning July 1, 6 1999, and for the payment of bills incurred and remaining unpaid 7 at the close of the fiscal year ending June 30, 1999. 8 (b) State Lottery Fund.--The following sums set forth in 9 this act, or as much thereof as may be necessary, are hereby 10 specifically appropriated from the State Lottery Fund to the 11 several hereinafter named agencies of the Executive Department 12 of the Commonwealth for the payment of salaries, wages or other 13 compensation and travel expenses of the duly appointed officers 14 and employees of the Commonwealth, for the payment of fees for 15 contractual services rendered, for the purchase or rental of 16 goods and services and for payment of any other expenses, as 17 provided by law or by this act, necessary for the proper conduct 18 of the duties, functions and activities and for the purposes 19 hereinafter set forth for the fiscal year beginning July 1, 20 1999, and for the payment of bills incurred and remaining unpaid 21 at the close of the fiscal year ending June 30, 1999. 22 (c) Energy Conservation and Assistance Fund.--The following 23 sums set forth in this act, or as much thereof as may be 24 necessary, are hereby specifically appropriated from the Energy 25 Conservation and Assistance Fund to the several hereinafter 26 named agencies of the Executive Department of the Commonwealth 27 for the payment of fees for contractual services rendered, for 28 the purchase or rental of goods and services and for the payment 29 of any other expenses, as provided by law or by this act, 30 necessary for the proper conduct of the duties, functions and 19990H0980B1088 - 10 -
1 activities and for the purposes hereinafter set forth for the 2 fiscal year beginning July 1, 1999, and for the payment of bills 3 incurred and remaining unpaid at the close of the fiscal year 4 ending June 30, 1999. 5 (d) Judicial Computer System Augmentation Account.--The 6 following sums set forth in this act, or as much thereof as may 7 be necessary, are hereby specifically appropriated from the 8 restricted receipt account established within the General Fund, 9 known as the Judicial Computer System Augmentation Account, to 10 the Judicial Department of the Commonwealth for the payment of 11 salaries, wages or other compensation and travel expenses, for 12 the payment of fees for contractual services rendered, for the 13 purchase or rental of goods and services and for the payment of 14 any other expenses, as provided by law or by this act, necessary 15 for the proper conduct of the duties, functions and activities 16 and for the purposes hereinafter set forth for the fiscal year 17 beginning July 1, 1999, and for the payment of bills incurred 18 and remaining unpaid at the close of the fiscal year ending June 19 30, 1999. 20 (e) Emergency Medical Services Operating Fund.--The 21 following sums set forth in this act, or as much thereof as may 22 be necessary, are hereby specifically appropriated from the 23 Emergency Medical Services Operating Fund to the several 24 hereinafter named agencies of the Executive Department of the 25 Commonwealth for the payment of fees for contractual services 26 rendered, for the purchase or rental of goods and services and 27 for the payment of any other expenses, as provided by law or by 28 this act, necessary for the proper conduct of the duties, 29 functions and activities and for the purposes hereinafter set 30 forth for the fiscal year beginning July 1, 1999, and for the 19990H0980B1088 - 11 -
1 payment of bills incurred and remaining unpaid at the close of 2 the fiscal year ending June 30, 1999. 3 (f) The State Stores Fund.--The following sums set forth in 4 this act, or as much thereof as may be necessary, are hereby 5 specifically appropriated from The State Stores Fund to the 6 hereinafter named agency of the Executive Department of the 7 Commonwealth for the payment of salaries, wages or other 8 compensation and travel expenses of the duly appointed officers 9 and employees of the Commonwealth, for the payment of fees for 10 contractual services rendered, for the purchase or rental of 11 goods and services and for the payment of any other expenses, as 12 provided by law or by this act, necessary for the proper conduct 13 of the duties, functions and activities and for the purposes 14 hereinafter set forth for the fiscal year beginning July 1, 15 1999, and for the payment of bills incurred and remaining unpaid 16 at the close of the fiscal year ending June 30, 1999. 17 (g) Motor License Fund.--The following sums, or as much 18 thereof as may be necessary, are hereby appropriated from the 19 Motor License Fund to the hereinafter named agencies of the 20 Executive Department for the payment of salaries, wages and 21 other compensation and travel expenses of the duly elected or 22 appointed officers and employees of the Commonwealth, for 23 contractual services and other expenses necessary for the proper 24 conduct of the duties, functions and activities for the purposes 25 hereinafter set forth for the fiscal year beginning July 1, 26 1999, and for the payment of bills incurred and remaining unpaid 27 at the close of the fiscal year ending June 30, 1999. 28 (h) Aviation Restricted Revenue Account.--The following 29 sums, or as much thereof as may be necessary, are hereby 30 appropriated from the Aviation Restricted Revenue Account in the 19990H0980B1088 - 12 -
1 Motor License Fund to the hereinafter named agencies of the 2 Executive Department for the purposes set forth herein for the 3 fiscal year beginning July 1, 1999, and for the payment of bills 4 incurred and remaining unpaid at the close of the fiscal year 5 ending June 30, 1999. 6 (i) Hazardous Material Response Fund.--The following sums 7 set forth in this act, or as much thereof as may be necessary, 8 are hereby specifically appropriated from the Hazardous Material 9 Response Fund to the several hereinafter named agencies of the 10 Executive Department of the Commonwealth for the payment of fees 11 for contractual services rendered, for the purchase or rental of 12 goods and services and for the payment of any other expenses, as 13 provided by law or by this act, necessary for the proper conduct 14 of the duties, functions and activities and for the purposes 15 hereinafter set forth for the fiscal year beginning July 1, 16 1999, and for the payment of bills incurred and remaining unpaid 17 at the close of the fiscal year ending June 30, 1999. 18 (j) Milk Marketing Fund.--The following sums set forth in 19 this act, or as much thereof as may be necessary, are hereby 20 specifically appropriated from the Milk Marketing Fund to the 21 several hereinafter named agencies of the Executive Department 22 of the Commonwealth for the payment of salaries, wages or other 23 compensation and travel expenses of the duly appointed officers 24 and employees of the Commonwealth, for the payment of fees for 25 contractual services rendered, for the purchase or rental of 26 goods and services and for the payment of any other expenses, as 27 provided by law or by this act, necessary for the proper conduct 28 of the duties, functions and activities and for the purposes 29 hereinafter set forth for the fiscal year beginning July 1, 30 1999, and for the payment of bills incurred and remaining unpaid 19990H0980B1088 - 13 -
1 at the close of the fiscal year ending June 30, 1999. 2 (k) Home Investment Trust Fund.--The following sums set 3 forth in this act, or as much thereof as may be necessary, are 4 hereby specifically appropriated from the Home Investment Trust 5 Fund to the hereinafter named agencies of the Executive 6 Department of the Commonwealth for the payment of salaries, 7 wages or other compensation and travel expenses of the duly 8 appointed officers and employees of the Commonwealth, for the 9 payment of fees for contractual services rendered, for the 10 purchase or rental of goods and services and for the payment of 11 any other expenses, as provided by law or by this act, necessary 12 for the proper conduct of the duties, functions and activities 13 and for the purposes hereinafter set forth for the fiscal year 14 beginning July 1, 1999, and for the payment of bills incurred 15 and remaining unpaid at the close of the fiscal year ending June 16 30, 1999. 17 (l) Ben Franklin/IRC Partnership Fund.--The following sums 18 set forth in this act, or as much thereof as may be necessary, 19 are hereby specifically appropriated from the Ben Franklin/IRC 20 Partnership Fund to the hereinafter named agencies of the 21 Executive Department of the Commonwealth for the payment of 22 salaries, wages or other compensation and travel expenses of the 23 duly appointed officers and employees of the Commonwealth, for 24 the payment of fees for contractual services rendered, for the 25 purchase or rental of goods and services and for the payment of 26 any other expenses, as provided by law or by this act, necessary 27 for the proper conduct of the duties, functions and activities 28 and for the purposes hereinafter set forth for the fiscal year 29 beginning July 1, 1999, and for the payment of bills incurred 30 and remaining unpaid at the close of the fiscal year ending June 19990H0980B1088 - 14 -
1 30, 1999. 2 (m) Tuition Payment Fund.--The following sums set forth in 3 this act, or as much thereof as may be necessary, are hereby 4 specifically appropriated from the Tuition Payment Fund to the 5 hereinafter named agencies of the Executive Department of the 6 Commonwealth for the payment of salaries, wages or other 7 compensation and travel expenses of the duly appointed officers 8 and employees of the Commonwealth, for the payment of fees for 9 contractual services rendered, for the purchase or rental of 10 goods and services and for the payment of any other expenses, as 11 provided by law or by this act, necessary for the proper conduct 12 of the duties, functions and activities and for the purposes 13 hereinafter set forth for the fiscal year beginning July 1, 14 1999, and for the payment of bills incurred and remaining unpaid 15 at the close of the fiscal year ending June 30, 1999. 16 (n) Banking Department Fund.--The following sums set forth 17 in this act, or as much thereof as may be necessary, are hereby 18 specifically appropriated from the Banking Department Fund to 19 the hereinafter named agencies of the Executive Department of 20 the Commonwealth for the payment of salaries, wages or other 21 compensation and travel expenses of the duly appointed officers 22 and employees of the Commonwealth, for the payment of fees for 23 contractual services rendered, for the purchase or rental of 24 goods and services and for the payment of any other expenses, as 25 provided by law or by this act, necessary for the proper conduct 26 of the duties, functions and activities and for the purposes 27 hereinafter set forth for the fiscal year beginning July 1, 28 1999, and for the payment of bills incurred and remaining unpaid 29 at the close of the fiscal year ending June 30, 1999. 30 (o) Firearm Records Check Fund.--The following sums set 19990H0980B1088 - 15 -
1 forth in this act, or as much thereof as may be necessary, are 2 hereby specifically appropriated from the Firearm Records Check 3 Fund to the hereinafter named agencies of the Executive 4 Department of the Commonwealth for the payment of salaries, 5 wages or other compensation and travel expenses of the duly 6 appointed officers and employees of the Commonwealth, for the 7 payment of fees for contractual services rendered, for the 8 purchase or rental of goods and services and for the payment of 9 any other expenses, as provided by law or by this act, necessary 10 for the proper conduct of the duties, functions and activities 11 and for the purposes hereinafter set forth for the fiscal year 12 beginning July 1, 1999, and for the payment of bills incurred 13 and remaining unpaid at the close of the fiscal year ending June 14 30, 1999. 15 Section 105. Federal augmentation appropriations.--The 16 following Federal augmentation appropriations set forth in this 17 act, or as much thereof as may be necessary, are hereby 18 specifically appropriated from the Federal augmentation funds to 19 the several hereinafter named agencies of the Executive and 20 Judicial Departments of the Commonwealth for the payment of the 21 expenses of implementing and carrying out the programs stated 22 herein for the fiscal year beginning July 1, 1999, and for the 23 payment of bills incurred and remaining unpaid at the close of 24 the fiscal year ending June 30, 1999. Unless otherwise stated, 25 the appropriations include any carryovers from the prior fiscal 26 year. 27 Section 106. Block grants.--(a) Appropriation.--The 9 following sums set forth in this act, or as much thereof as may 10 be necessary, are hereby specifically appropriated from the 11 block grant (BG) funds to the several hereinafter named agencies 12 of the Executive Department of the Commonwealth for the 13 purposes, and under the restrictions, for which the funds are 14 provided for the fiscal year beginning July 1, 1999. 15 (b) Small Communities Development Block Grant.--The Small 16 Communities Development Block Grant (SCDBG) is to assist small 17 cities and communities that have a high concentration of 18 impoverished citizens and substandard housing to expand their 19 low-income and moderate-income housing opportunities and to meet 20 community development needs. 21 (c) Community Services Block Grant.--The Community Services 22 Block Grant (CSBG) is to provide a range of services and 23 activities having a measurable and potentially major impact on 24 the causes of poverty in the community or those areas of the 25 community where poverty is a particularly acute problem. In 26 addition, new focus may be placed on the unemployed, both old 27 and new. Local agencies may lower their eligibility requirements 28 for recipients to three months to allow greater flexibility to 29 assure proper consideration of each recipient. 30 (d) Preventive Health and Health Services Block Grant.--The 19990H0980B1088 - 17 -
1 Preventive Health and Health Services Block Grant (PHHSBG) is 2 for the provision of preventive health and other health services 3 related to emergency medical systems, health initiative grants, 4 comprehensive public health, hypertension, fluoridation, health 5 education, risk reduction, home health, rape crisis and domestic 6 violence services. 7 (e) Maternal and Child Health Services Block Grant.--The 8 Maternal and Child Health Services Block Grant (MCHSBG) is to 9 enable states to maintain and strengthen their leadership in 10 planning, promoting, coordinating and evaluating health care for 11 pregnant women, mothers, infants and children, and children with 12 special health care needs, and in providing health services for 13 mothers and children who do not have access to adequate health 14 care. 15 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 16 Income Home Energy Assistance Block Grant (LIHEABG) is to help 17 lessen the impact of the high cost of energy on low-income 18 families and individuals, including energy efficiency grants for 19 low-income dwellings. No less than 15% of the LIHEABG funds 20 received shall be used for weatherization. LIHEABG funds 21 received pursuant to a Presidential release of weather-related 22 contingency funds shall be exempt from the 15% requirement if 23 the weather emergency has an impact in Pennsylvania. Unexpended 24 weatherization funds which would result in LIHEABG funds being 25 returned to the Federal Department of Health and Human Services 26 may be spent for assistance grants at the discretion of the 27 Secretary of the Budget. The Secretary of the Budget shall 28 notify the majority chairman and the minority chairman of the 29 Appropriations Committee of the Senate and the majority chairman 30 and the minority chairman of the Appropriations Committee of the 19990H0980B1088 - 18 -

General provisions.--The Secretary of the 2 Budget may create the restricted receipt accounts set forth in 3 this part for the purpose of administering Federal grants only 4 for the purposes herein designated during the fiscal year July 5 1, 1999, through June 30, 2000. 6 Section 1602. Executive Offices.--The following restricted 7 receipt accounts may be established for the Executive Offices: 8 (1) "Pennsylvania Commission on Crime and Delinquency - 9 Juvenile Justice and Delinquency Prevention." 10 (2) "Pennsylvania Commission on Crime and Delinquency - 11 Federal Crime Victim Assistance." 12 (3) "Pennsylvania Commission on Crime and Delinquency - 13 Juvenile Justice - Title V." 14 (4) "Pennsylvania Commission on Crime and Delinquency - 15 Federal Juvenile Accountability Incentive." 16 Section 1603. Department of Community and Economic 17 Development.--The following restricted receipt accounts may be 18 established for the Department of Community and Economic 19 Development: 20 (1) "ARC Housing Revolving Loan Program." 21 Section 1604. Department of Conservation and Natural 22 Resources.--The following restricted receipt accounts may be 23 established for the Department of Conservation and Natural 24 Resources: 25 (1) "Federal Aid to Volunteer Fire Companies." 26 (2) "Federal Land and Water Conservation Fund Act." 27 (3) "National Forest Reserve Allotment." 28 (4) "Federal Land and Water Conservation Fund Act - 29 Conservation and Natural Resources." 30 Section 1605. Department of Environmental Protection.--The 13 following restricted receipt accounts may be established for the 14 Department of Environmental Protection: 15 (1) "Federal Water Resources Planning Act." 16 (2) "Flood Control Payments." 17 (3) "Soil and Water Conservation Act - Inventory of 18 Programs." 19 Section 1607. Department of Transportation.--The following 20 restricted receipt accounts may be established for the 21 Department of Transportation: 22 (1) "Capital Assistance Elderly and Handicapped Programs." 23 (2) "Railroad Rehabilitation and Improvement Assistance." 24 (3) "Ridesharing/Van Pool Program - Acquisition." 25 Section 1608. Pennsylvania Emergency Management Agency.--The 26 following restricted receipt account may be established for the 27 Pennsylvania Emergency Management Agency: 28 (1) "Receipts from Federal Government - Disaster Relief - 29 Disaster Relief Assistance to State and Political Subdivisions." 30 Section 1609. 1 Commission.--The following restricted receipt account may be 2 established for the Pennsylvania Historical and Museum 3 Commission: 4 (1) "Federal Grant - Historical Preservation Act of 1966." 5 PART XVII 6 SPECIAL PROVISIONS FOR FEDERAL FUNDS 7 FOR 1999-2000 8 Section 1701. General Fund repository for Federal funds.-- 9 All moneys received from the Federal Government as contributions 10 or supplements to the departments or agencies of the 11 Commonwealth or the programs herein provided shall be paid into 12 the General Fund. 13 Section 1702. Limitation on encumbering or spending Federal 14 funds.--Federal funds shall be encumbered or spent only to the 15 extent that such funds are estimated as being available during 16 the fiscal year of the Commonwealth. 17 Section 1703. Appropriation of prior unspent Federal 18 funds.--Any Federal money which has been previously appropriated 19 by the General Assembly and authorized or allocated by the 20 Federal Government but remains unspent from prior fiscal years 21 and will not be renewed for fiscal year 1999-2000 is hereby 22 appropriated. 23 Section 1704. Subgrants between Federal fund 24 appropriations.--With the exception of Federal money received 25 under JTPA and SSBG, subgrants may be made between 26 appropriations without further approval of the General Assembly. 27 The Secretary of the Budget shall submit a list of subgrants to 28 the Chairmen and minority chairmen of the House and Senate 29 Appropriations Committees quarterly. No subgrant to a State 30 agency, however, may be made from a restricted receipt account 19990H0980B1088 - 189 -
1 without a specific appropriation by the General Assembly. 2 Section 1705. Utilization of emergency Federal funds.--(a) 3 Federal funds available for costs and damages resulting from 4 natural disasters or civil disobedience may be added to an 5 appropriation contained in this act or to funds appropriated or 6 may be used for the purposes prescribed by the Federal 7 Government. 8 (b) In addition to the moneys appropriated by this act, all 9 moneys received from the Federal Government for the purpose of 10 disaster assistance or relief shall be paid into the General 11 Fund and are hereby appropriated out of the General Fund to the 12 departments, boards, commissions or agencies designated by the 13 Governor. 14 (c) In the event of any emergency situation in which the 15 General Assembly cannot act in sufficient time, the Governor is 16 authorized through executive authorization to provide up to 17 $10,000,000 in Federal funds to alleviate the emergency 18 situation. For the purposes of this section, "emergency" is 19 defined as any situation in which there is a chance of or which 20 may result in substantial human suffering. 21 PART XVIII 22 MISCELLANEOUS PROVISIONS FOR 1999-2000 23 Section 1801. Prior laws unaffected.--Except as provided in 24 section 253, this act is not intended to be inconsistent with or 25 to repeal any provision of any act enacted at this or any prior 26 session of the General Assembly regulating the purchase of 27 supplies, the ordering of printing and binding, the purchase, 28 maintenance and use of automobiles, the method of making 29 payments from the State Treasury for any purpose or the 30 functioning of any administrative department, board or 19990H0980B1088 - 190 -
1 commission. 2 Section 1802. Compliance with other law before funds 3 available.--No appropriation made by this act to any department, 4 board, commission or agency of the Executive Department shall be 5 available unless and until the department, board, commission or 6 agency has complied with sections 615 and 616 of the act of 7 April 9, 1929 (P.L.177, No.175), known as The Administrative 8 Code of 1929. 9 Section 1803. Contracts prerequisite to encumbering or 10 committing funds.--Funds available to agencies, boards, 11 departments, commissions, or other governmental entities under 12 this act for the procurement of supplies, services or 13 construction shall not be available for payment of, or to be 14 committed to or encumbered for payment of, any such procurement 15 unless and until the agency, board, department or other 16 governmental entity has complied with all of the requirements 17 applicable to the procurement that are set out in 62 Pa.C.S. 18 (relating to procurement) and in the policies, procedures and 19 regulations instituted in accordance with that code. 20 Section 1804. Minority business set-asides.--(a) Each 21 department or other instrumentality of the Commonwealth listed 22 in Subpart A of Part II authorized to contract for buildings, 23 highways, commodities, equipment, supplies or services shall 24 report to the General Assembly all information pertinent to 25 anticipated procurement needs at the beginning of each fiscal 26 year and each fiscal quarter thereafter. 27 (b) As used in this section, the term "minority business" 28 means a minority business enterprise as defined in the act of 29 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 30 Minority Business Development Authority Act. 19990H0980B1088 - 191 -
1 Section 1805. Appropriation of funds from miscellaneous 2 sources.--(a) In addition to the amounts appropriated by this 3 act, moneys received in payment for food and household supplies 4 furnished to employees and other persons, except inmates, by an 5 institution, and moneys received from the proceeds from the sale 6 of any products of the soil, meats, livestock, timber or other 7 materials sold by the department shall be paid into the General 8 Fund and are hereby appropriated out of the General Fund to the 9 several respective institutions for the operation and 10 maintenance of the institutions. 11 (b) In addition to the amounts appropriated by this act, all 12 moneys received from any other source, except the Federal 13 Government, as contributions for the programs provided herein or 14 as payment for services or materials furnished by one 15 institution to another, except those collections designated as 16 revenues, shall be paid into the General Fund and are hereby 17 appropriated out of the General Fund for the purposes of the 18 respective appropriations. 19 (c) In addition to any funds specifically appropriated by 20 this act, all moneys received by a department or agency of the 21 Commonwealth from any other sources, except the Federal 22 Government, as contributions or supplements to the department or 23 agency for a program or administration of an act included in 24 this act shall be paid into the General Fund and credited to the 25 appropriation for that program or administration of the act. 26 Section 1806. Lapsing of unused funds.--(a) Except as 27 otherwise provided by law or by this section, that part of all 28 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 29 XI, XII, XIII, XIV and XV unexpended, uncommitted or 30 unencumbered as of June 30, 2000, shall automatically lapse as 19990H0980B1088 - 192 -
1 of that date. 2 (b) The appropriations in Part II to the Legislative 3 Department shall be continuing appropriations. 4 Section 1807. Appellate courts appropriation contingency.-- 5 The funds appropriated in Part II to the Supreme, Superior and 6 Commonwealth Courts for justice and judge expenses are 7 contingent upon a vouchered expense account plan being continued 8 by the Supreme Court. 9 Section 1808. Transfer of excess funds.--The Governor may 10 transfer any excess money in those funds receiving proceeds of 11 Commonwealth of Pennsylvania general obligation bonds in excess 12 of the amount necessary for the purposes for which the bonds 13 were issued to the appropriate sinking fund for payment of debt 14 service due on outstanding bonds. If such excess funds, together 15 with any available balance, exceed the amount of debt service 16 remaining to be paid, the funds shall be transferred to the 17 General Fund or to the appropriate special fund responsible for 18 such debt service. 19 Section 1809. Transfer of funds by the Supreme Court.--(a) 20 The Supreme Court may transfer any excess funds appropriated in 21 sections 281, 285, 286, 287, 288, 289, 290, 291 and 292 to the 22 Judicial Department in Part II to the Judicial Computer 23 Augmentation Account during the month of June 2000. No transfer 24 may create or increase a deficiency in the appropriation from 25 which the transfer is made. Whenever the Supreme Court makes a 26 transfer under this subsection, the Supreme Court shall give 27 written notification to the Secretary of the Budget and chairman 28 and minority chairman of the Senate Committee on Appropriations 29 and the chairman and the minority chairman of the House of 30 Representatives Committee on Appropriations ten days prior to 19990H0980B1088 - 193 -
1 any transfer which shall also include certification that such 2 transfer will not result in a deficit in any appropriation. 3 (b) The Supreme Court may transfer funds appropriated in 4 section 281 between the line items in that section provided that 5 no transfer may create or increase a deficiency in the 6 appropriation from which the transfer is made. Whenever the 7 Supreme Court makes a transfer under this subsection, the 8 Supreme Court shall give written notification to the Secretary 9 of the Budget and the chairman and minority chairman of the 10 Senate Committee on Appropriations and the chairman and the 11 minority chairman of the House of Representatives Committee on 12 Appropriations ten days prior to any transfer which shall also 13 include certification that such transfer will not result in a 14 deficit in any appropriation. 15 Section 1810. Transfer from Hazardous Sites Cleanup Fund.-- 16 The sum of $12,000,000 is transferred from the Hazardous Sites 17 Cleanup Fund to the Industrial Sites Cleanup Fund. 18 Section 1811. Transfer from Pennsylvania Minority Business 19 Development Fund.--The sum of $1,000,000 is transferred from the 20 Pennsylvania Minority Business Development Fund to the Small 21 Business First Fund. 22 PART XIX 23 EFFECTIVE DATE 24 Section 1901.
