AN ACT
1 Providing for police force augmentation grants; establishing the
2 Police Force Augmentation Fund; conferring powers and duties
3 on the Department of Community Affairs; and making an
4 appropriation.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Short title.
8 This act shall be known and may be cited as the Police Force
9 Augmentation Grant Act.
10 Section 2. Definitions.
11 The following words and phrases when used in this act shall
12 have the meanings given to them in this section unless the
13 context clearly indicates otherwise:
14 "Department." The Department of Community Affairs of the
15 Commonwealth.
16 "Fund." The Police Force Augmentation Fund established in
17 section 3.
18 "Municipality." A city, borough, incorporated town or
1 township.
2 Section 3. Fund.
3 (a) Establishment.--The Police Force Augmentation Fund is
4 established as a separate fund in the State Treasury.
5 (b) Source.--The source of the fund shall be appropriations.
6 (c) Administration.--The department shall administer the
7 fund to make grants under section 4.
8 Section 4. Grants.
9 (a) General rule.--The department may make a grant of up to
10 $15,000 to a municipality for augmentation of the municipality's
11 police force. A grant shall be based upon all of the following:
12 (1) Need as determined by crime statistics acceptable to
13 the department.
14 (2) The balance in the fund.
15 (b) Application.--A municipality must apply for a grant by
16 August 31. The application shall provide all of the following:
17 (1) The amount requested.
18 (2) The projected use of the money received.
19 (3) Justification for the grant under subsection (a)(1).
20 (c) Disposition.--The department shall make a decision on
21 grant applications by October 31. Failure to make a decision on
22 an application by October 31 shall be deemed approval of the
23 application. A decision by the department under this subsection
24 shall be deemed an adjudication subject to 2 Pa.C.S. Ch. 7
25 Subch. A (relating to judicial review of Commonwealth agency
26 action).
27 Section 5. Regulations.
28 The department may promulgate regulations to administer this
29 act.
30 Section 6. Appropriation.

1 The sum of $15,000,000 is hereby appropriated to the Police
2 Force Augmentation Fund for the fiscal year July 1, 1995, to
3 June 30, 1996, to carry out the provisions of this act. This
4 appropriation shall not lapse at the end of the fiscal year.
5 Section 7. Applicability.
6 This act shall apply beginning with the first State fiscal
7 year which starts after the effective date of this act.
8 Section 8. Effective date.
9 This act shall take effect immediately.
