        AS REPORTED FROM COMMITTEE ON JUDICIARY, HOUSE OF
           REPRESENTATIVES, AS AMENDED, APRIL 13, 1999

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     sentencing procedure for murder of the first degree.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 9711(i) of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 9711.  Sentencing procedure for murder of the first degree.
     9     * * *
    10     (i)  Record of death sentence to Governor.--[Within 90 days
    11  of the date a sentence of death is upheld by the Supreme Court]
    12  Where a sentence of death is upheld by the Supreme Court, the
    13  prothonotary of the Supreme Court shall transmit to the Governor
    14  a full and complete record of the trial, sentencing hearing,
    15  imposition of sentence and review by the Supreme Court within 90  <--


     1  days of the expiration of the time period for filing a petition
     2  for writ of certiorari or extension thereof, or disposition of
     3  the writ of certiorari by the United States Supreme Court.
     4  IMPOSITION OF SENTENCE AND [REVIEW] OPINION BY THE SUPREME COURT  <--
     5  WITHIN 30 DAYS OF ONE OF THE FOLLOWING:
     6         (1)  THE EXPIRATION OF THE TIME PERIOD FOR FILING A
     7     PETITION FOR WRIT OF CERTIORARI OR EXTENSION THEREOF;
     8         (2)  THE DENIAL OF A PETITION FOR WRIT OF CERTIORARI; OR
     9         (3)  THE DISPOSITION OF THE APPEAL BY THE UNITED STATES
    10     SUPREME COURT, IF THAT COURT GRANTS THE PETITION FOR WRIT OF
    11     CERTIORARI. Notice of this transmission shall
    12     contemporaneously be provided to the Secretary of
    13     Corrections.
