AN ACT
1 Amending the act of May 31, 1945 (P.L.1198, No.418), entitled,
2 as amended, "An act providing for the conservation and
3 improvement of land affected in connection with surface
4 mining; regulating such mining; and providing penalties,"
5 requiring that all blasting effects be confined to the area
6 of the surface mining activity.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Subsection (b) of section 4.2, act of May 31,
10 1945 (P.L.1198, No.418), known as the "Surface Mining
11 Conservation and Reclamation Act," amended November 30, 1971
12 (P.L.554, No.147), is amended to read:
13 Section 4.2. Health and Safety.--* * *
14 (b) The use of explosives for the purpose of blasting in
15 connection with surface mining shall be done in accordance with
16 regulations promulgated by and under the supervision of the
17 secretary. The primary and secondary effects of the use of
18 explosives for the purpose of blasting in connection with
19 surface mining operations shall be confined totally to the area
20 of the surface mining operation.
