AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," repealing provisions relating to the 6 Board of State College and University Directors. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Sections 2003.1, 2003.2 and 2003.3, act of March 10 10, 1949 (P.L.30, No.14), known as the "Public School Code of 11 1949," are repealed. 12 Section 2. Sections 2004 and 2004.1, the first paragraph of 13 2008 and sections 2008.2 and 2008.3 of the act added or amended 14 February 17, 1970 (P.L.24, No.13), clause (16) of section 2004.1 15 added August 1, 1975 (P.L.168, No.86), are amended to read: 16 Section 2004. Board of Presidents of State Colleges and 17 State Universities.--The Board of Presidents of the State 18 Colleges and State Universities shall consist of the presidents 19 of the several colleges and universities and the Secretary of 20 Education, who shall be the chairman. The board shall recommend
1 educational policies for State Colleges and State Universities
2 [and shall act in an advisory capacity to the Board of State
3 College and University Directors]. The board shall meet annually
4 or at the call of its chairman. A majority of the board shall
5 constitute a quorum.
6 Section 2004.1. Management of State Colleges and State
7 Universities within the Department.--[Subject to the stated
8 authority of the Board of State College and University Directors
9 and the boards of trustees, the] The president of each of the
10 several State Colleges and State Universities shall administer
11 the institution. Each president shall have the power and his
12 duty shall be:
13 (1) To appoint such officers, faculty members, graduate
14 assistants, and employes as may be necessary in accordance with
15 law, and the standards set by the Executive Board of the
16 Commonwealth [and the Board of State College and University
17 Directors].
18 (2) To fix the salaries of instructional and
19 noninstructional employes in accordance with law, and the
20 standards set by the Executive Board of the Commonwealth [and
21 policies of the Board of State College and University
22 Directors].
23 (3) To make rules for the administration of the college or
24 university including rules under which student organizations may
25 be created and operated.
26 (4) To prepare and submit, with the approval of the boards
27 of trustees, the annual operating and capital budget
28 requirements for the institution.
29 (5) To determine from appropriations, fees and other
30 available funds, the expenditures to be made for instructional,

1 administrative, custodial and maintenance services, equipment 2 and supplies, and for furniture for instructional, 3 administrative and service facilities, and to reallocate such 4 sums among the various expenditure classifications as may be 5 necessary for the effective management of the institution, 6 providing that no such reallocation shall exceed the available 7 allocations of the institutions. 8 (6) To purchase instructional materials, educational, 9 technical, administrative, custodial and maintenance equipment 10 and supplies not in excess of a cost of one thousand five 11 hundred dollars ($1,500) without competitive bidding with the 12 approval of the Board of Trustees, after notice to the Secretary 13 of [Property and Supplies] General Services, except that such 14 items shall not be bought in series to avoid the dollar ceiling, 15 nor shall any items be included for which the Department of 16 [Property and Supplies] General Services has contracts, either 17 through schedules or group purchase contracts, current or 18 proposed. 19 (7) To cooperate with and accept grants and assistance from 20 Federal and State agencies, foundations, industrial 21 corporations, or any other source in the prosecution of research 22 or educational projects including purchase of equipment. Each 23 college and university shall have the power to bank and use such 24 grants as directed by the grantor, subject, however, to the 25 provisions of clause (6) of this section, where applicable. All 26 moneys received from such sources are hereby appropriated to 27 each of the several State Colleges and State Universities 28 granted such moneys. All such moneys shall be subject to audit 29 by the Auditor General. 30 (8) To authorize personnel to travel within or without the 19790H0875B0952 - 3 -
1 Commonwealth at State expense [in accordance with regulations of 2 the Board of State College and University Directors]. 3 (9) To make rules for the admission, control, and movement 4 of persons and vehicles, and the parking of vehicles on the 5 campus or other land of a State College or State University and 6 to provide reasonable charges for the use thereof, as well as 7 reasonable penalties for the violation of said rules. 8 (10) To define academic standards and standards for 9 admission [in accordance with regulations of the Board of State 10 College and University Directors]. 11 (11) To make contracts with school districts, agencies or 12 corporations so that students may engage in student teaching or 13 other professional training in order to obtain experience in a 14 particular field. 15 (12) To fix student activity and related fees [in accordance 16 with policies established by the Board of State College and 17 University Directors]. 18 (13) To enter with the approval of the Board of Trustees 19 into contracts for consultative services not to exceed one 20 thousand dollars ($1000). 21 (14) To establish rules regarding employment rights, 22 promotions, dismissals and tenure of faculty and other employes, 23 subject to the approval of the Board of Trustees [and in 24 accordance with broad policies established by the Board of State 25 College and University Directors]. 26 (15) To determine institutional memberships in learned 27 societies and professional organizations which will have 28 significance to the welfare of the institution [within the 29 limits established by the Board of State College and University 30 Directors]. 19790H0875B0952 - 4 -
1 (16) At his discretion, to make contribution to those 2 volunteer fire companies that provide fire protection to the 3 property of State Colleges and State Universities, subject to 4 the approval of the Board of Trustees. 5 Section 2008. Board and Fees.--The cost of room, board and 6 fees shall be fixed by the Secretary of Education [upon 7 recommendation of the Board of State College and University 8 Directors]. 9 * * * 10 Section 2008.2. Duties of Boards of Trustees of the Several 11 State Colleges.--The Board of Trustees of each of the several 12 State Colleges shall have the powers and its duties shall be: 13 (1) To review all matters pertaining to the welfare and 14 well-being of the college and its students and to make 15 recommendations to the president with respect thereto. 16 (2) To recommend to the Governor [through the Board of State 17 College and University Directors] the appointment of a 18 president. 19 (3) To represent the Commonwealth at official functions of 20 the college. 21 (4) To develop means and methods of establishing proper 22 relations and understanding between the college and its program 23 and the public in order to serve the interests and needs of 24 both. 25 (5) To establish grievance procedures for State College 26 employes in accordance with policies established by the 27 appropriate Commonwealth agencies. 28 (6) To conduct an annual physical inspection of facilities 29 [and make recommendations to the Board of State College and 30 University Directors]. 19790H0875B0952 - 5 -
1 (7) To approve the annual operating and capital budget 2 requirements for the institution prepared by the president [and 3 to forward same to the Board of State College and University 4 Directors]. 5 (8) To review and approve all direct purchases made by the 6 president without competitive bidding. 7 (9) To approve the appointment of all employes in accordance 8 with law, and standards set by the Executive Board of the 9 Commonwealth and the Civil Service Commission[, and policies of 10 the Board of State College and University Directors]. 11 (10) To review and approve contracts for consultative 12 services entered into by the president. 13 (11) To approve recommendations of the president pertaining 14 to the waiver of fees. 15 Section 2008.3. Duties of the Boards of Trustees of the 16 Several State Universities.--The Board of Trustees of each State 17 University shall have the powers and its duties shall be to: 18 (1) Formulate plans for the growth and development of the 19 university. 20 (2) Approve recommendations of the president pertaining to 21 (i) budgets and expenditures [and forward same to the Board of 22 State College and University Directors]; (ii) the waiver of 23 fees; (iii) schools and curricular programs; and (iv) the 24 appointment, rank, salaries, tenure of instructional staff and 25 noninstructional staff and administrative personnel in 26 accordance with law, and standards set by the Executive Board of 27 the Commonwealth and the Civil Service Commission[, and policies 28 of the Board of State College and University Directors]. 29 (3) Make policies providing for the admission and expulsion 30 of students, courses of instruction and for all other matters 19790H0875B0952 - 6 -
1 related to the government and administration of the university. 2 (4) Exercise such other powers and perform such other duties 3 as are necessary to carry into effect the provisions of this 4 act. 5 (5) To recommend to the Governor [through the Board of State 6 College and University Directors] the appointment of a 7 president. 8 (6) To review and approve all direct purchases made by the 9 president without competitive bidding. 10 (7) To grant, on behalf of the university, [subject to the 11 approval by the Board of State College and University 12 Directors,] the degrees of bachelor of arts, bachelor of 13 science, and bachelor of fine arts for successful completion of 14 prescribed undergraduate courses of study, and the degrees of 15 master of education, master of arts, master of science, doctor 16 of education, and doctor of philosophy for successful completion 17 of prescribed graduate courses of study, as well as other 18 degrees recommended by the Board of Trustees [and approved by 19 the Board of State College and University Directors]. 20 Section 3.
