AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for 21 number and qualifications for membership on the State Board 22 of Medical Education and Licensure. 23 The General Assembly of the Commonwealth of Pennsylvania 24 hereby enacts as follows: 25 Section 1. Section 412, act of April 9, 1929 (P.L.177, 26 No.175), known as "The Administrative Code of 1929," amended 27 September 1, 1961 (P.L.1149, No.514), is amended to read:
1 Section 412. State Board of Medical Education and 2 Licensure.--The State Board of Medical Education and Licensure 3 shall consist of [seven] nine members, two of whom shall be the 4 [Superintendent of Public Instruction] Commissioner of 5 Professional and Occupational Affairs in the Department of State 6 and the Secretary of Health, the [five] seven remaining members 7 shall be appointed [from the membership or those eligible for 8 membership in the Pennsylvania Medical Society. The Pennsylvania 9 Medical Society, after consultation with the deans of the 10 medical schools in Pennsylvania, shall submit a list of names 11 to] by the Governor [for his consideration in filling vacancies 12 on the Board. 13 Each of the five members appointed, shall, at the time of his 14 appointment, be licensed and qualified under the existing laws 15 of this Commonwealth to practice medicine and surgery, and shall 16 have practiced the same in this Commonwealth for a period of not 17 less than ten years prior to his appointment. No member of the 18 board shall be a member of the faculty of any undergraduate 19 school or college or university teaching medicine or surgery.] 20 as follows: 21 (i) Four members shall be physicians who are licensed to 22 practice medicine and surgery in the Commonwealth and shall be 23 chosen from among candidates whose names have been submitted to 24 the Governor by the Pennsylvania Medical Society; 25 (ii) One member shall be a physician licensed to practice 26 medicine and surgery in the Commonwealth who is a dean of one of 27 the medical colleges in Pennsylvania, and he shall be chosen 28 from among candidates whose names have been submitted to the 29 Governor by the deans of the medical colleges in Pennsylvania; 30 (iii) One member shall be a person who is knowledgeable in 19730H0759B0877 - 2 -
1 the field of allied health sciences; and 2 (iv) One member shall be a person representing the public at 3 large. 4 The terms of members of the board shall be four years from 5 the respective dates of their appointment. 6 [Four] Five members of the board shall constitute a quorum. 7 The board shall select, from among their number, a chairman, 8 and shall elect a secretary who need not be a member of the 9 board. 10 Each member of the board, other than the [Superintendent of 11 Public Instruction] Commissioner of Professional and 12 Occupational Affairs and the Secretary of Health, shall receive 13 [fifteen] thirty dollars per diem, while actually engaged in the 14 work of the board. The secretary shall receive such reasonable 15 compensation as shall be determined by the board, with the 16 approval of the [Superintendent of Public Instruction] 17 Commissioner of Professional and Occupational Affairs.
