                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," further providing for
     5     the acquisition and use of real property; and further
     6     providing for the authority to construct county buildings.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 2505 of the act of July 28, 1953
    10  (P.L.723, No.230), known as the Second Class County Code, is
    11  amended to read:
    12     Section 2505.  Acquiring and Using Real Property[; Court
    13  Approval; Exceptions].--(a)  The county commissioners, upon
    14  their determination of the necessities of the county, may
    15  acquire by purchase, [take by] gift, devise or [by the] power of
    16  eminent domain[, in accordance with the provisions of this act,]
    17  such real [property at the county seat or in such other places,
    18  as may be authorized by law, as they deem necessary] estate
    19  within the county for the purposes of [a county courthouse,] the


     1  erection or extension of a county building or buildings,
     2  including without limitation for the purposes of county jail,
     3  prison, workhouse, detention house [or other county building,
     4  either in acquisition of a building suitable for such purposes
     5  or in the construction of a new building, or in the alteration,
     6  including enlargement, of an existing county building. Any
     7  purchase herein authorized shall be subject to the approval of
     8  the court of common pleas of the county as to purchase price,
     9  and no such contract shall bind the county, nor shall any
    10  conveyance be valid until the court has so approved the purchase
    11  price] and storage of county and county offices' records, either
    12  in the acquisition of a building for such purposes or in the
    13  construction of a new building, or in the alteration, including
    14  the enlargement, of an existing building: Provided, however, The
    15  courthouse and offices of the county officers shall be located
    16  at the county seat.
    17     (b)  The county commissioners may also use any real [property
    18  at the county seat or elsewhere, as authorized by law,] estate
    19  within the county, owned by the county, and deemed suitable [by
    20  them] for the purposes aforesaid[, except such property as is
    21  bound by contract to another public use].
    22     (c)  The county commissioners may provide for the grading,
    23  filling, draining, gardening and otherwise improving and
    24  maintaining of all lands for county buildings, either by
    25  contract or by county employes, as they deem proper.
    26     (d)  To the extent that any of the matters provided for
    27  herein are otherwise specifically provided for by law, with
    28  regard to any particular acquisitions of real property by
    29  counties, either by tax sales or by other purchases, this
    30  section shall not apply to such matters.

     1     Section 2.  Section 2515 of the act is repealed.
     2     Section 3.  This act shall take effect immediately.
