| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, providing for restitution |
3 | for tampering with evidence or public records or information. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 42 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 9720.3. Restitution for tampering with evidence or public |
9 | records or information. |
10 | (a) General rule.--The court may, in addition to any other |
11 | restitution sentence or order authorized by law, sentence a |
12 | person convicted of a violation of 18 Pa.C.S. § 4910 (relating |
13 | to tampering with or fabricating physical evidence) or a |
14 | violation of 18 Pa.C.S. § 4911 (relating to tampering with |
15 | public records or information) to make restitution for all |
16 | reasonable expenses incurred by the victim or on the victim's |
17 | behalf: |
18 | (1) to investigate the circumstances surrounding the |

1 | defendant's violation of 18 Pa.C.S. § 4910 or 4911; |
2 | (2) to bring or defend civil or criminal actions related |
3 | to the defendant's violation of 18 Pa.C.S. § 4910 or 4911; or |
4 | (3) to take other corrective or remedial efforts in |
5 | connection with the defendant's violation of 18 Pa.C.S. § |
6 | 4910 or 4911. |
7 | (b) Types of expenses.--The types of expenses that may be |
8 | recoverable under this section include, but are not limited to: |
9 | (1) Attorney fees. |
10 | (2) Court costs and filing fees. |
11 | (3) Any other expense the court deems proper. |
12 | Section 2. The addition of 42 Pa.C.S. § 9720.3 shall apply |
13 | to offenses committed on or after the effective date of this |
14 | act. |
15 | Section 3. This act shall take effect in 60 days. |
