AN ACT
1 Amending Title 23 (Domestic Relations) of the Pennsylvania
2 Consolidated Statutes, further providing for restrictions on
3 the issuance of a marriage license.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 1304(b) of Title 23 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 1304. Restrictions on issuance of license.

10 (b) Minors.--
11 (1) No marriage license may be issued if either of the
12 applicants for a license is under 16 years of age unless the
13 court decides that it is to the best interest of the
14 applicant and authorizes the issuance of the license.
15 (2) No marriage license may be issued if either of the
16 applicants is under 18 years of age unless the consent of [a]
17 the custodial parent or guardian of the applicant is
18 personally given before the person issuing the license or is
1 certified under the hand of [a] the custodial parent or
2 guardian attested by two adult witnesses and, in the latter
3 case, the signature of the custodial parent or guardian is
4 acknowledged before an officer authorized by law to take
5 acknowledgments. When the minor has no guardian and a judge
6 of the court is absent or not accessible for any reason, the
7 office issuing the license may appoint a guardian pro hac
8 vice for the minor.

10 Section 2. This act shall take effect in 60 days.
