AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES, JULY 13, 1977
AN ACT 1 Amending the act of June 3, 1937 (P.L.1333, No.320), entitled 2 "An act concerning elections, including general, municipal, 3 special and primary elections, the nomination of candidates, 4 primary and election expenses and election contests; creating 5 and defining membership of county boards of elections; 6 imposing duties upon the Secretary of the Commonwealth, 7 courts, county boards of elections, county commissioners; 8 imposing penalties for violation of the act, and codifying, 9 revising and consolidating the laws relating thereto; and 10 repealing certain acts and parts of acts relating to 11 elections," PROVIDING FOR CERTAIN COMPATIBLE OFFICES; <-- 12 requiring the home address at the time of application for an 13 absentee ballot of persons in the military service and 14 requiring additional information to be included on expense 15 accounts. 16 The General Assembly of the Commonwealth of Pennsylvania 17 hereby enacts as follows: 18 SECTION 1. THE ACT OF JUNE 3, 1937 (P.L.1333, NO.320), KNOWN <-- 19 AS THE "PENNSYLVANIA ELECTION CODE," IS AMENDED BY ADDING A 20 SECTION TO READ: 21 SECTION 808.2. COMPATIBLE OFFICES.--ANY CONSTABLE OR ANY 22 EMPLOYE OF A COMMON PLEAS COURT OR A DISTRICT JUSTICE MAY BE AN
1 OFFICER OF ANY POLITICAL BODY OR POLITICAL PARTY, AND MAY HOLD 2 THE OFFICE OF A COUNTY, STATE OR NATIONAL COMMITTEE OF ANY 3 POLITICAL PARTY, AND MAY RUN FOR AND HOLD ANY ELECTIVE OFFICE, 4 AND MAY PARTICIPATE IN ANY ELECTION DAY ACTIVITIES. 5 Section 1 2. Subsection (b) of section 1302, act of June 3, <-- 6 1937 (P.L.1333, No.320) known as the "Pennsylvania Election 7 Code," OF THE ACT, amended December 11, 1968 (P.L.1183, No.375), <-- 8 is amended to read: 9 Section 1302. Applications for Official Absentee Ballots.-- 10 * * * 11 (b) The application shall contain the following information: 12 Home residence in Pennsylvania at the time of [entrance into 13 actual military service or Federal employment] application, 14 length of time a citizen, length of residence in Pennsylvania, 15 date of birth, length of time a resident of voting district, 16 voting district if known, party choice in case of primary, name 17 and, for a military elector, his stateside military address, FPO 18 or APO number and serial number. Any elector other than a 19 military elector shall in addition specify the nature of his 20 employment, the address to which ballot is to be sent, 21 relationship where necessary, and such other information as may 22 be determined and prescribed by the Secretary of the 23 Commonwealth. When such application is received by the Secretary 24 of the Commonwealth it shall be forwarded to the proper county 25 board of election. 26 * * * 27 Section 2 3. Subsection (a) of section 1607 of the act <-- 28 amended July, 1, 1976 (P.L.523, No.124), is amended to read: 29 Section 1607. Expense Accounts to Be Filed.-- 30 (a) Every candidate for nomination or election, and every 19770H0656B1779 - 2 -
1 treasurer of a political committee, or person acting as such 2 treasurer, shall, within thirty days after every primary and 3 election at which such candidate was voted for or with which 4 such political committee was concerned, if the amount received 5 or expended or liabilities incurred shall exceed the sum of one 6 hundred fifty dollars, file a full, true and detailed account, 7 subscribed and sworn to by him, setting forth each and every sum 8 of money received, contributed or disbursed by him for primary 9 or election expenses, the date of each receipt, contribution and 10 disbursement, the name of the person from whom received or to 11 whom paid, and the specific object or purpose for which the same 12 was disbursed. As to contributors, the account shall include the 13 person's first and last name AND home address and, if <-- 14 applicable, occupation and employer furnished to such political 15 committee by the written statement of the contributor, who shall 16 be responsible for its accuracy. Where the contribution is from <-- 17 a person other than an individual, only the full name and 18 address shall be set forth. No employer shall reward or punish 19 any employe for contributing, or failing to contribute, to the 20 campaign of any candidate. Such account shall also set forth the 21 unpaid debts and liabilities of any such candidate or committee 22 for primary or election expenses, with the nature and amount of 23 each, and to whom owing. In the case of the treasurer of a 24 political committee, the account shall include any unexpended 25 balance of contributions or other receipts appearing from the 26 last previous account filed by him, and shall also include a 27 complete listing of all receipts and disbursements made by such 28 committee for any purpose, including all receipts and 29 disbursements from the publication and sale of all publications, 30 and from the time of the last account or from the time of the 19770H0656B1779 - 3 -
1 formation of the political committee if no prior account has
2 been filed. In the case of candidates for election who have
3 previously filed accounts of their primary expenses as
4 candidates for nomination, the accounts shall only include
5 receipts, contributions and disbursements subsequent to the date
6 of such prior accounts.
7 Notwithstanding the foregoing paragraph, where any amount
8 received or contributed is not more than fifty ($50) dollars,
9 such amounts may be aggregated according to the date of receipt
10 or contribution. In such cases, the name of the person from whom
11 received or contributed need not be set forth. However, where
12 the candidate for nomination or election, treasurer of a
13 political committee, or person acting as a treasurer, knows or
14 has reason to know that a person has, through multiple
15 contributions, contributed more than a total of fifty ($50)
16 dollars, he must make a full, true and detailed account and
17 report of what he knows or has reason to know.
