AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further defining the term "special mobile
3 equipment"; and further providing for violations relating to
4 registration.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. The definition of "special mobile equipment" in
8 section 102 of Title 75 of the Pennsylvania Consolidated
9 Statutes is amended to read:
10 § 102. Definitions.
11 Subject to additional definitions contained in subsequent
12 provisions of this title which are applicable to specific
13 provisions of this title, the following words and phrases when
14 used in this title shall have, unless the context clearly
15 indicates otherwise, the meanings given to them in this section:

17 "Special mobile equipment."
18 (1) Vehicles not designed or used primarily for the
1 transportation of persons or property, except for tools and
2 parts necessary for the use and maintenance of the vehicle,
3 and only [incidentally] occasionally operated or moved over a
4 highway[, including but].
5 (2) Trucks which have machinery permanently attached, do
6 not carry a load, except for tools and parts necessary for
7 the use and maintenance of the machinery, and are only
8 occasionally operated or moved over a highway.
9 The term includes, but is not limited to: ditch digging
10 apparatus, well boring apparatus; earth moving and road
11 construction and maintenance machinery, such as asphalt
12 spreaders, bituminous mixers, bucket loaders, snowplows,
13 ditchers, graders, finishing machines, road rollers, scarifiers,
14 earth moving carryalls, scrapers, power shovels [and], drag
15 lines, street sweepers, pipe cleaners, catch basin cleaners,
16 truck-mounted augers, lime spreaders, bucket trucks; and self-
17 propelled cranes and tractors, other than truck tractors. The
18 term does not include house trailers; dump trucks; or truck-
19 mounted transit mixers[, cranes or shovels; or other vehicles
20 designed for the transportation of persons or property to which
21 machinery has been attached].

23 Section 2. Section 1301(a) of Title 75 is amended to read:
24 § 1301. Registration and certificate of title required.
25 (a) Driving unregistered or improperly registered vehicle
26 prohibited.--No person shall drive or move and no owner shall
27 knowingly permit to be driven or moved upon any highway any
28 vehicle which is not registered or is improperly registered in
29 this Commonwealth unless the vehicle is exempt from
30 registration.
