AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," providing for the 21 establishment and operation of a Sportsmen Advisory Council 22 to advise the Pennsylvania Fish Commission and the 23 Pennsylvania Game Commission. 24 The General Assembly of the Commonwealth of Pennsylvania 25 hereby enacts as follows: 26 Section 1. The introductory paragraph of section 448 of the 27 act of April 9, 1929 (P.L.177, No.175), known as The 28 Administrative Code of 1929, amended June 6, 1945 (P.L.1398,
1 No.446), is amended and the section is amended by adding a 2 clause to read: 3 Section 448. Advisory Boards and Commissions.--The advisory 4 boards and commissions, within the several administrative 5 departments and independent commissions, shall be constituted as 6 follows: 7 * * * 8 (q) (1) The Sportsmen Advisory Council shall consist of the 9 Executive Director of the Pennsylvania Fish Commission, the 10 Executive Director of the Pennsylvania Game Commission, five 11 members who shall be appointed by the Governor, no more than 12 three of whom shall be of the same political party, five members 13 who shall be appointed by the President pro tempore of the 14 Senate, no more than three of whom shall be of the same 15 political party, and five members who shall be appointed by the 16 Speaker of the House of Representatives, no more than three of 17 whom shall be of the same political party. The appointed members 18 of the Sportsmen Advisory Council shall be citizens of this 19 Commonwealth, who, during their respective terms, shall hold no 20 other State office to which any salary is attached. 21 (2) The term of office of each appointed member shall be 22 three years, measured from the third Tuesday of January of the 23 year in which he takes office, or until his successor has been 24 appointed; except that in the initial appointments of the 25 members of the Sportsmen Advisory Council, the respective 26 appointing authorities shall appoint two members for terms of 27 one year each, two members for terms of two years each, and one 28 member for a term of three years. 29 (3) The Sportsmen Advisory Council shall include persons 30 knowledgeable in fields related to the work of the Pennsylvania 19910H0617B0682 - 2 -
1 Fish Commission and the Pennsylvania Game Commission such as, 2 but not limited to, ecology, land management, water pollution, 3 boating, cold-water fisheries, warm-water fisheries, game 4 management, landowner relations, endangered and threatened 5 species, critical habitat and such other matters as may relate 6 to the operations of the Pennsylvania Fish Commission or 7 Pennsylvania Game Commission. 8 (4) The Sportsmen Advisory Council shall annually elect one 9 of its appointed members as chairman and shall elect a secretary 10 who need not be a member of the Sportsmen Advisory Council. 11 Meetings of the Sportsmen Advisory Council shall be held at 12 least quarterly or at the call of the chairman. 13 (5) The Sportsmen Advisory Council shall have power to 14 employ and fix the compensation of such experts, stenographers 15 and assistants as may be deemed necessary to carry out the work 16 of the Sportsmen Advisory Council, but due diligence shall be 17 exercised by the Sportsmen Advisory Council to enlist such 18 voluntary assistance as may be available from citizens, research 19 organizations, and other agencies in Pennsylvania or elsewhere, 20 generally recognized as qualified to aid the Sportsmen Advisory 21 Council. The expenses of the Sportsmen Advisory Council shall be 22 paid equally from the Fish Fund and the Game Fund. 23 (6) The Sportsmen Advisory Council shall review all hunting, 24 trapping, fishing and boating laws of this Commonwealth and make 25 appropriate suggestions for the revision, modification and 26 codification thereof. 27 (7) The Sportsmen Advisory Council shall consider, study and 28 review the work of the Pennsylvania Fish Commission and the 29 Pennsylvania Game Commission and for this purpose, the Sportsmen 30 Advisory Council shall have access to all books, papers, 19910H0617B0682 - 3 -
1 documents and records pertaining or belonging to the 2 Pennsylvania Fish Commission or the Pennsylvania Game 3 Commission. 4 (8) The Sportsmen Advisory Council shall advise the 5 Pennsylvania Fish Commission and the Pennsylvania Game 6 Commission, on request, and shall make recommendations upon its 7 initiative, for the improvement of the work of the Pennsylvania 8 Fish Commission and the Pennsylvania Game Commission. Advice and 9 recommendations made by the Sportsmen Advisory Council shall not 10 be binding upon the commissions. 11 (9) The Sportsmen Advisory Council shall report annually to 12 the Governor and to the General Assembly and may make such 13 interim reports as are deemed advisable. 14 Section 2.
