AN ACT 1 Amending the act of July 19, 1979 (P.L.130, No.48), entitled "An 2 act relating to health care; prescribing the powers and 3 duties of the Department of Health; establishing and 4 providing the powers and duties of the State Health 5 Coordinating Council, health systems agencies and Health Care 6 Policy Board in the Department of Health, and State Health 7 Facility Hearing Board in the Department of Justice; 8 providing for certification of need of health care providers 9 and prescribing penalties," providing for escrow accounts for 10 residents of personal care homes. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. The act of July 19, 1979 (P.L.130, No.48), known 14 as the Health Care Facilities Act, is amended by adding a 15 section to read: 16 Section 821. Escrow accounts for personal care home residents. 17 (a) Accounts.--An operator of a personal care home for 18 adults shall deposit any security deposit of a resident into a 19 separate escrow account. 20 (b) Interest.--A resident of a personal care home for adults 21 shall receive all interest from the escrow account upon leaving
1 the home. 2 (c) Forfeiture prohibited.--A resident of a personal care 3 home for adults shall not forfeit a security deposit when forced 4 to leave the home for care in a hospital, hospice or nursing 5 home. 6 (d) Definition.--As used in this section the term "personal 7 care home for adults" means any facility licensed under this act 8 in which food, shelter and personal assistance or supervision 9 are provided for a period exceeding 24 hours for more than three 10 adults who are not relatives of the operator and who require 11 assistance or supervision in such matters as dressing, bathing, 12 diet or medication prescribed for self administration. 13 Section 2.
