           O'KEEFE, GALLEN, ARTHURS AND ECKENSBERGER, FEBRUARY 26, 1975

        AS RE-REPORTED FROM COMMITTEE ON APPROPRIATIONS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, MAY 10, 1976

                                     AN ACT

     1  Amending the act of May 29, 1935 (P.L.244, No.102), entitled "An
     2     act creating a Local Government Commission to study and
     3     report on functions of local government; their allocation and
     4     elimination; the cost of local government and means of
     5     reducing it; and the consolidation of local government; and
     6     making an appropriation," providing for the publishing and
     7     distribution of certain codes.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of May 29, 1935 (P.L.244, No.102),
    11  entitled "An act creating a Local Government Commission to study
    12  and report on functions of local government; their allocation
    13  and elimination; the cost of local government and means of
    14  reducing it; and the consolidation of local government; and
    15  making an appropriation," is amended by adding sections to read:
    16     Section 2.1.  (a) It shall be the duty of the commission to
    17  arrange for the compilation and distribution of The County Code,
    18  The Third Class City Code, The Borough Code, The First Class
    19  Township Code, The Second Class Township Code, a uniform

     1  procedural code relating to all classes of local government and
     2  all temporary or permanent supplements or amendments to the
     3  aforementioned codes.
     4     (b)  The commission shall promulgate regulations relating to
     5  the distribution of the aforementioned codes without reference
     6  to the restrictions placed upon or fixed for the distribution of
     7  other publications of the Commonwealth. The regulations shall
     8  provide for free distribution upon request, of at least one copy
     9  of every publication printed under authority of this act to
    10  each:
    11     1.  Political subdivision governed by such code;
    12     2.  County for use of its Law Library;
    13     3.  Member of the General Assembly;
    14     4.  Law School Library which pursuant to rules of court
    15  receives copies of printed briefs and records filed in the
    16  Supreme Court of Pennsylvania;
    17     5.  State Law Library of the Commonwealth of Pennsylvania.
    18     (C)  UPON REQUEST BY A MEMBER OF THE GENERAL ASSEMBLY, COPIES  <--
    19  OF THOSE PUBLICATIONS REFERRED TO IN SECTION 2.1 WILL BE
    20  DISTRIBUTED TO THE INDICATED PARTIES EITHER THROUGH THE MEMBER'S
    21  OFFICE OR THROUGH THE COMMISSION AS INDICATED BY THE MEMBER.
    22     Section 2.2.  The Department of General Services shall be
    23  responsible for the printing of the codes and the temporary and
    24  permanent supplements thereto.
    25     The codes and temporary and permanent supplements or
    26  amendments shall be printed in loose-leaf form so that the pages
    27  may be inserted in a ring binder book.
    28     Section 2.  This act shall take effect immediately.
