AN ACT
1 Amending the act of September 27, 1961 (P.L.1700, No.699),
2 entitled "An act relating to the regulation of the practice
3 of pharmacy, including the sales, use and distribution of
4 drugs and devices at retail; and amending, revising,
5 consolidating and repealing certain laws relating thereto,"
6 further providing for the applicability of continuing
7 pharmacy education requirements.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Section 3.1 of the act of September 27, 1961
11 (P.L.1700, No.699), known as the Pharmacy Act, added December
12 20, 1985 (P.L.433, No.111), is amended to read:
13 Section 3.1. Continuing Pharmacy Education.--(a) The board
14 shall develop and adopt rules and regulations necessary to
15 establish an accredited program of continuing pharmaceutical
16 education. The board shall have the authority to:
17 (1) Define, by regulation, the requirement for continuing
18 education, after consultation with the educational community and
19 licensed pharmacists, within one year of the enactment of this
20 amendatory act.
1 (2) Approve programs of continuing education within one year 2 of the enactment of this amendatory act. 3 (3) Effective with 1988 renewals, refuse to renew the 4 license of a pharmacist until the pharmacist submits proof to 5 the board that he has satisfactorily completed an approved 6 program of continuing professional education during the previous 7 licensing period to help assure his or her continued competence 8 to engage in the practice of pharmacy. 9 (4) Adopt rules and regulations necessary to carry out the 10 stated objectives and purposes and to enforce this section, 11 which shall include the methods of determining approved programs 12 and any fees as the board shall determine. 13 (b) This section and rules and regulations adopted pursuant 14 to this section shall not apply to individuals who have been 15 registered or licensed to practice pharmacy for fifty years or 16 more. 17 Section 2.
