        AS REPORTED FROM COMMITTEE ON AGING AND YOUTH, HOUSE OF
           REPRESENTATIVES, AS AMENDED, DECEMBER 8, 1993

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for the
     3     inspection of court files and records in cases involving
     4     juvenile matters.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 6307 of Title 42 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 6307.  Inspection of court files and records.
    10     All files and records of the court in a proceeding under this
    11  chapter are open to inspection only by:
    12         (1)  The judges, officers and professional staff of the
    13     court.
    14         (2)  The parties to the proceeding and their counsel and
    15     representatives, but the persons in this category shall not


     1     be permitted to see reports revealing the names of
     2     confidential sources of information contained in social
     3     reports, except at the discretion of the court.
     4         (3)  A public or private agency or institution providing
     5     supervision or having custody of the child under order of the
     6     court.
     7         (4)  A court and its probation and other officials or
     8     professional staff and the attorney for the defendant for use
     9     in preparing a presentence report in a criminal case in which
    10     the defendant is convicted and who prior thereto had been a
    11     party to a proceeding under this chapter.
    12         (5)  A judge or issuing authority for use in determining
    13     bail, PROVIDED THAT SUCH INSPECTION IS LIMITED TO ORDERS OF    <--
    14     DELINQUENCY ADJUDICATIONS AND DISPOSITIONS AND PETITIONS
    15     RELATING THERETO, ORDERS RESULTING FROM DISPOSITION REVIEW
    16     HEARINGS AND HISTORIES OF BENCH WARRANTS AND ESCAPES.
    17         [(5)] (6)  The Administrative Office of Pennsylvania
    18     Courts.
    19         [(6)] (7)  With leave of court, any other person or
    20     agency or institution having a legitimate interest in the
    21     proceedings or in the work of the unified judicial system.
    22     Section 2.  This act shall take effect immediately.
