                                     AN ACT

     1  Concerning consumer protection, providing for the retail pricing
     2     of food and foodstuffs, and prescribing penalties for
     3     violations thereof.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  It shall be an unlawful practice for any person
     7  to sell, attempt to sell or offer for sale at retail any food or
     8  foodstuffs unless the price is plainly marked thereon by a
     9  stamp, tag, label or sign affixed thereto. Once such food or
    10  foodstuffs have been marked, the price thereof cannot be
    11  increased; however, in the case of a sale, the price can be
    12  reduced. A list containing the reduced prices of such sale items
    13  shall be posted at the checkout counter of such place of
    14  business.
    15     Section 2.  Upon receiving evidence of any violation of the
    16  provisions of this act, the Attorney General or his designee, is
    17  empowered to hold hearings upon said violation and upon finding
    18  the violation to have been committed, to assess a penalty


     1  against the person alleged to have committed such violation of
     2  not more than $1,000. Any such amounts collected by the Attorney
     3  General shall be paid forthwith into the State Treasury for the
     4  general purposes of the State.
     5     Section 3.  This act shall take effect immediately.
