AN ACT 1 Amending the act of April 29, 1959 (P.L.58), entitled "An act 2 consolidating and revising the Vehicle Code, the Tractor 3 Code, the Motor Vehicle Financial Responsibility Act and 4 other acts relating to the ownership, possession and use of 5 vehicles and tractors," requiring any person who owns, 6 operates or rides a motorcycle to carry protective headgear 7 as required equipment. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 625.1, act of April 29, 1959 (P.L.58), 11 known as "The Vehicle Code," amended July 15, 1968 (Act No. 12 162), is amended to read: 13 Section 625.1. Owners, Operators and Others Riding on 14 Motorcycle.--A person owning or operating a motorcycle shall 15 ride only upon the permanent and regular seat attached thereto. 16 Such owner or operator shall not carry any other person nor 17 shall any other person ride on a motorcycle, unless such 18 motorcycle is designed to carry more than one person, in which 19 event, a passenger may ride upon the permanent and regular seat 20 if designed for two (2) persons, or upon another seat firmly
1 attached to the motorcycle in a position to the rear or side of 2 the motorcycle and provided with foot rests and hand grips, or 3 in a side car attached to the motorcycle. Any person owning, 4 operating or riding on a motorcycle shall [wear both] carry as 5 required equipment, protective headgear and if such person is 6 not wearing eyeglasses, an eye shield of a type approved by the 7 secretary. Such protective headgear and eye shield is required 8 equipment, and must be present on the motorcycle at time of 9 purchase, inspection, and at all times the motorcycle is in 10 operation. 11 Penalty.--Any person owning, operating or riding a motorcycle 12 in violation of any of the provisions of this section shall, 13 upon summary conviction before a magistrate, be sentenced to pay 14 a fine of ten dollars ($10.00) and costs of prosecution, and, in 15 default of the payment thereof, shall undergo imprisonment for 16 not more than five (5) days.
