                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, providing for sealed bids for the
     3     purchase of coal by electric utilities.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 66, act of November 25, 1970 (P.L.707,
     7  No.230), known as the Pennsylvania Consolidated Statutes, is
     8  amended by adding a section to read:
     9  § 514.  Bidding requirements by electric utilities.
    10     All purchases of coal by an electric utility for the


     1  generation of electricity shall be awarded on a sealed bid basis
     2  to the lowest responsible bidder from at least three qualified
     3  suppliers. Duplicate copies of all bids shall be sent by the
     4  bidder to the commission at least 48 hours prior to the opening
     5  of the bids. The utility shall notify the commission of the
     6  successful bidder and the bid price and an explanation of the
     7  reasons if it is not awarded to the lowest bidder.
     8     Section 2.  This act shall take effect in 60 days.
