AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for required financial 3 responsibility. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 1786(d) of Title 75 of the Pennsylvania 7 Consolidated Statutes, amended December 16, 1992 (P.L. , 8 No.165), is amended to read: 9 § 1786. Required financial responsibility. 10 * * * 11 (d) Suspension of registration and operating privilege.--The 12 Department of Transportation shall suspend the registration of a 13 vehicle if it determines the required financial responsibility 14 was not secured as required by this chapter and shall suspend 15 the operating privilege of the owner or registrant for a period 16 of three months if the department determines that the owner or 17 registrant has operated or permitted the operation of the
1 vehicle without the required financial responsibility. The 2 operating privilege shall not be restored until the restoration 3 fee for operating privilege provided by section 1960 (relating 4 to reinstatement of operating privilege or vehicle registration) 5 is paid. Whenever the department revokes or suspends the 6 registration of any vehicle under this chapter, the department 7 shall not restore the registration until the vehicle owner 8 furnishes proof of financial responsibility in a manner 9 determined by the department and submits an application for 10 registration to the department, accompanied by the fee for 11 restoration of registration provided by section 1960. This 12 subsection shall not apply in the following circumstances: 13 (1) The owner or registrant: 14 (i) has not previously had a lapse in financial 15 responsibility coverage; 16 (ii) proves the lapse in financial responsibility 17 coverage is for a period of 30 days or less; 18 (iii) did not operate or permit the operation of the 19 vehicle during the period of lapse in financial 20 responsibility; and 21 (iv) furnishes proof of financial responsibility 22 within 30 days of receiving notice from the department 23 that he has a lapse in coverage. 24 [(1)] (2) The owner or registrant, who has previously 25 had a lapse in financial responsibility coverage, proves to 26 the satisfaction of the department that the lapse in 27 financial responsibility coverage was for a period of less 28 than 31 days and that the owner or registrant did not operate 29 or permit the operation of the vehicle during the period of 30 lapse in financial responsibility. 19930H0541B0592 - 2 -
1 [(2)] (3) The owner or registrant is a member of the
2 armed services of the United States, the owner or registrant
3 has previously had the financial responsibility required by
4 this chapter, financial responsibility had lapsed while the
5 owner or registrant was on temporary, emergency duty and the
6 vehicle was not operated during the period of lapse in
7 financial responsibility. The exemption granted by this
8 paragraph shall continue for 30 days after the owner or
9 registrant returns from duty as long as the vehicle is not
10 operated until the required financial responsibility has been
11 established.
