AN ACT 1 Amending the act of June 2, 1915 (P.L.736, No.338), entitled, as 2 amended, "An act defining the liability of an employer to pay 3 damages for injuries received by an employe in the course of 4 employment; establishing an elective schedule of 5 compensation; providing procedure for the determination of 6 liability and compensation thereunder; and prescribing 7 penalties," increasing certain compensation rates. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Clause (h) of section 306, act of June 2, 1915 11 (P.L.736, No.338), known as "The Pennsylvania Workmen's 12 Compensation Act," reenacted and amended June 21, 1939 (P.L.520, 13 No.281) and added December 5, 1974 (P.L.782, No.263), is amended 14 to read: 15 Section 306. The following schedule of compensation is 16 hereby established: 17 * * * 18 (h) Any person receiving compensation under sections 306(a), 19 306(b), 306(c)(23), or section 307, as a result of an accident 20 which occurred prior to [the effective date of the amendatory
1 act of January 17, 1968 (P.L.6, No.4)] January 1, 1973 shall 2 have the compensation rate adjusted to the level they would have 3 received had the injury occurred on [the effective date of the 4 amendatory act of January 17, 1968 (P.L.6, No.4)] January 1, 5 1973 and had the injured employe been earning wages equal to 6 [ninety dollars ($90)] one hundred fifty dollars ($150) per 7 week. The additional compensation shall be paid by the self- 8 insured employer or insurance carrier making payment and shall 9 be reimbursed in advance by the Commonwealth on a quarterly 10 basis as provided in rules and regulations of the department. 11 The payment of additional compensation shall be made by the 12 carrier or self-insured employer only during those fiscal years 13 for which appropriations are made to cover reimbursement. 14 Section 2. (a) This act shall take effect immediately. 15 (b) The increase in compensation payments provided for 16 herein shall commence on July 1 next following the date of final 17 enactment of this amendatory act, provided an appropriation has 18 been made to cover the increase in reimbursements necessary for 19 such increase in compensation payments.
