AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, in registration of vehicles, further providing for

3

person with disability plate and placard.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1338(b) of Title 75 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 1338.  Person with disability plate and placard.

(b)  Person with disability parking placard.--

11

(1)  A physician, podiatrist, chiropractor, physician

12

assistant or certified registered nurse practitioner licensed

13

or certified to practice in this Commonwealth or in a

14

contiguous state who has determined that a person with a

15

disability is disabled as provided in subsection (a) may

16

issue a temporary special parking placard to the person. The

17

temporary special parking placard shall be on a form approved

18

by the department and shall be valid for a period of not more

than 90 days.

(2)  On the initial application or renewal application of

3

any person who meets the qualifications of subsection (a),

4

the department shall issue one special parking placard of

5

such size and design as the department shall specify,

6

designating the vehicle in which it is displayed as being

7

used for the transportation of persons with disabilities.

(3)  When parking the designated vehicle, the [person

9

with] disability parking placard shall be prominently

10

displayed in such a manner that it may be viewed from the

11

front and rear of the vehicle by hanging it from the front

12

windshield rearview mirror of a vehicle only when that

13

vehicle is utilizing a parking space reserved for persons

14

with disabilities. When there is no rearview mirror, or the

15

placard is not designed in such a manner to accommodate

16

hanging from a rearview mirror, the placard shall be

17

displayed on the dashboard.

(4)  Placards may also be issued for use in vehicles when

19

operated for the use and benefit of persons with disabilities

20

provided that a person with a disability is being transported

21

in the vehicle. Organizations that transport persons with

22

disabilities shall upon application be issued not more than

23

eight placards in the organization's name. These placards may

24

be used in a vehicle of the organization or the personal

25

vehicle of an employee or volunteer of the organization when

26

the employee or volunteer operates the vehicle for the

27

benefit and use of persons with disabilities provided that a

28

person with a disability is being transported in the vehicle.

Section 2.  This act shall take effect in 60 days.
