AN ACT 1 Amending the act of April 12, 1951 (P.L.90, No.21), entitled "An 2 act relating to alcoholic liquors, alcohol and malt and 3 brewed beverages; amending, revising, consolidating and 4 changing the laws relating thereto; regulating and 5 restricting the manufacture, purchase, sale, possession, 6 consumption, importation, transportation, furnishing, holding 7 in bond, holding in storage, traffic in and use of alcoholic 8 liquors, alcohol and malt and brewed beverages and the 9 persons engaged or employed therein; defining the powers and 10 duties of the Pennsylvania Liquor Control Board; providing 11 for the establishment and operation of State liquor stores, 12 for the payment of certain license fees to the respective 13 municipalities and townships, for the abatement of certain 14 nuisances and, in certain cases, for search and seizure 15 without warrant; prescribing penalties and forfeitures; 16 providing for local option, and repealing existing laws," 17 further providing for the salaries of the board; and 18 reestablishing the board under the Sunset Act. 19 The General Assembly of the Commonwealth of Pennsylvania 20 hereby enacts as follows: 21 Section 1. Section 201 of the act of April 12, 1951 (P.L.90, 22 No.21), known as the Liquor Code, amended November 23, 1976 23 (P.L.1123, No.235), is amended to read: 24 Section 201. Appointment of Members; Terms; Salaries.--An 25 independent administrative board to be known as the
1 "Pennsylvania Liquor Control Board" is hereby created. The board 2 shall consist of three members to be appointed by the Governor 3 by and with the advice and consent of two-thirds of all the 4 members of the Senate. Of the original members, one shall be 5 appointed for a term of two years, one for a term of four years, 6 and one for a term of six years from the date of his appointment 7 and until his successor shall have been appointed and qualified. 8 Thereafter, all appointments shall be made by the Governor by 9 and with the advice and consent of two-thirds of all the members 10 of the Senate and shall be for terms of six years or until 11 successors are appointed and qualified. Each of the members 12 shall receive an annual salary of [twenty-four thousand dollars 13 ($24,000)] forty thousand dollars ($40,000), except the 14 chairman, who shall receive an annual salary of [twenty-five 15 thousand dollars ($25,000)] forty-five thousand five hundred 16 dollars ($45,500). 17 Section 2. This act, with respect to the Pennsylvania Liquor 18 Control Board, constitutes the legislation required to 19 reestablish an agency under the act of December 22, 1981 20 (P.L.508, No.142), known as the Sunset Act. 21 Section 3. The presently confirmed members of the existing 22 Pennsylvania Liquor Control Board, as of December 31, 1986, 23 shall continue to serve as members of the board. 24 Section 4. Each rule and regulation of the Pennsylvania 25 Liquor Control Board in effect on December 31, 1986, shall 26 remain in effect until amended or repealed by the board. 27 Section 5. Sections 2, 3 and 4 of this act shall be 28 retroactive to December 31, 1986. 29 Section 6. This act shall take effect in 15 days. B10L47JAM/19870H0451B0489 - 2 -
