AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, requiring compliance with Federal Selective Service
3requirements as part of application for learners' permits or
4drivers' licenses.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1.  Title 75 of the Pennsylvania Consolidated
8Statutes is amended by adding a section to read:

9§ 1521.  Compliance with Federal Selective Service requirements.

10(a)  General rule.--Any United States citizen or immigrant 
11who applies for a learner's permit, identification card or 
12driver's license or a renewal of such permit, card or license 
13and who is at least 18 years of age, but less than 26 years of 
14age, must comply with the requirements of section 3 of the 
15Military Selective Service Act (62 Stat. 604, 50 U.S.C. App. § 
16451 et seq.).

17(b)  Effect of applicant's signature.--The applicant's
18signature on the application shall serve as an indication that

1the applicant either has already registered with the Selective
2Service System or consents to registration if required to
3consent unless the applicant affirmatively indicates lack of
4consent by checking the box provided on the application.

5(c)  Notification to applicant.--The department shall place a
6check-off box as required under subsection (b) and the following
7statement on the application:

8By signing this application you are consenting to
9registration with the Selective Service System, if so
10required by Federal law, unless you affirmatively
11indicate your lack of consent by placing a check mark in
12the box provided herein. Failure to register, if required
13to do so, is a felony.

14(d)  Failure to consent.--If the applicant declines to
15consent to registration with the Selective Service System, the
16department shall not deny the applicant a license or
17identification card for failure to consent to registration.

18(e)  Reporting of information.--

19(1)  The department shall forward, in electronic format
20to the Selective Service System, the necessary personal
21information of the applicants required to comply with the
22Military Selective Service Act. If the applicant fails to
23consent to registration, the department shall forward, in
24electronic format to the Selective Service System, the
25necessary personal information along with a notation that
26registration was declined.

27(2)  Within 60 days of forwarding the information to the
28Selective Service System under paragraph (1), the department
29shall notify the applicant in writing that the information
30has been so forwarded.

1(f)  Memorandum of understanding.--The department shall seek
2to enter into a memorandum of understanding with the Selective
3Service System to obtain reimbursement of costs incurred by the
4department in carrying out the provisions of this section. The
5department shall publish in the Pennsylvania Bulletin notice of
6the execution of the memorandum of understanding within 14 days
7of its execution.

8Section 2.  The addition of 75 Pa.C.S. § 1521 shall apply
9upon publication of the notice under 75 Pa.C.S. § 1521(f).

10Section 3.  This act shall take effect in 60 days.
